Strictly speaking that would be correct. BUT, as I have experienced in the past, the authorities would see you both at fault. Overtaker should make an effort to keep clear but if lane 3, as in this scenario, is not free to use either by restriction or traffic, then it would be seen as a misjudgement of distance required to complete the manouvre. Overtakee can see the signs and has time to adjust speed to allow the overtaker to pass.
To be clear. Overtaker has not completed the manouvre until he is clear ahead of Overtakee. It is the responsibility of BOTH to be safe.

Just done the maths and it would take a minute to gain 60 yards on him with a 2MPH speed differential so you’d need probably a minute and a half to pull out and get ahead enough to pull back in safely, an artic being roughly 20 yards long. So if he was halfway down your trailer at the 1 mile marker with 45 seconds to go before you cleared him then if you’d continued as you were he would be pretty much stuck in L1 at the point of no return, certainly getting to the countdown markers for the exit.
And no it wouldn’t take you 200 yards to pass him, it would take you the thick end of 1000 yards leaving him maybe a few hundred yards and 15 seconds or so to get out, something thats not likely to happen if its someone like you behind you.

Indeed it is. People who were driving as long as me and longer would’ve moved over to let him out instead of just sitting there like you did. I can only think he’s an old timer who was expecting that courtesy which unfortunately new-comers like yourself seem not to be bothered with.
Since when has it been the overtakers problem if the overtakee cant be arsed to back off a bit to get into the lane he wants to be in?
Did the overtakee know for sure that the overtaker had no one down the side or approaching at speed in lane 3?

Thank you! I always judge my overtaking on the a1 as it is duel carriageway and don’t want to hold up car drivers and Conors answer was trolling drivel so have kept away. Always keep at 55 these days so if I know I can pass easily at 56 I can get past. That is all. Move on now.
There is no point getting irate over other truckies or drivers in general: They’ll be in and out of your life in minutes, probably never to be seen again. Sometimes when there is particularly profane verbal sparring over the CB between drivers, I cut in and quote Groundhog Day: DON"T DRIVE ANGRY.
