Quick question Coop, were you in slowly moving or stationary traffic in this incident? If stationary then why not bang it on break? Ok you can argue that it’s not “really” break sat on a motorway but who’s to know? And if it keeps your card straight then so much the better.

As an aside if I’m on a road where everything comes to a standstill I bang it on break, I may not get a 15 or a 45 but even 7 minutes on break is 7 minutes off of my working time.

i did stop for 5 mins hence there is three min break in there somewhere but good point about saving working time regardless of the 15/30/45 rules

If you are putting in, or taking out your card, isn`t that working?
It may record rest/break either side of you doing that, but the act of doing something work related is breaking that rest/break.

Either leave the card either in or out for all of the period, don`t touch anything during your rest/break.

(yes, problematic on those tachos stupidly set to revert to duty of you turn key to open windows)

This particular one was nones fault i had a whole string of unforseen events happen and i ran out of time and had to park up for the day (work nights) on a business park and the lorry was needed back at 7pm for someone else to use. However, i take your point

Depends on the job you’re doing I suppose, most of my shift is spent on and off break and can legitimately be explained if questioned by the powers that be. Regardless, any time that is not working, driving or poa and that you could be reading a newspaper, eating your sandwiches etc, I can’t see any problem at all recording this under rest mode whether it be 1 minute or 14 minutes, I must do a print off from one of my busiest shifts :laughing: and put it on here sometime.

FYI it’s impossible to have 33hrs as a daily rest.

An enforcement officers opinion matters not one iota as to whether it looks dodgy or not. Stationary and reading the Sun or perusing TNUK is recuperation which ever way you paint it, again it matters not one iota whether that be for one minute or one hour.

I have three reduced rests every week, and two of those days I use my 10 hour drive extension. Maxi g my hours benefits me, because I’m paid by the hour. Unfortunately on my last shift I struggle to get more than 10-11 hours, because when I get back to the yard, that’s me done.
