If you do have to give notice but you don’t and take the other job anyway what can happen ?

I don’t think any notice period is enforcable with agency work by it’s very nature of being temp work. That said, if you’re in a position to be a bit flexible I would cover for a few days until they can sort a replacement. Purely so I didn’t burn my bridges, you never know if you’ll need them again and a sure fire way to not get any work is to leave them in the lurch.
However, if your new job are screaming for you and it’s now or never, go today [zb] the agency!!
No and nothing but if they are a good agency explain whats happening in case you need to go back, if a bad one get paid then don’t turn up for next shift

I’ve been an agency driver for over 10 years. With different agencies at the same time.
If I’m booked at one place for a while I give a weeks notice if I hate it or if I have a better assignment. Otherwise I’ll tell them Friday is my last day.
Give them some notice at least.

There will more than likey be a finders fee for the agency due from your new employer. It’ll be in the contract somewhere.
As for terms of notice, that’ll be in your contract too.

Some/most agencies will happily spin you a yarn and keep you on the hook to suit their requirements, but when it comes to dropping you like a stone it’s worth remembering that they are probably only acting on what the client wants… So if you are currently working for the agency and looking to leave, try and do so on good terms as you never know when you may need them. Your new employer may want a reference for a start!
I gave a weeks notice to the last agency i worked for…wanted a week off before starting me new job and funnily enough thats exactly what i got cos they never gave me a single shift again.
However they were on the phone a week or so later desperate for me last weeks tachos in order to bill the customer, at this point they hadn’t paid me my holiday pay (and i’d been down this road with another bunch of sharks) so no cards till the pay appeared, the pay arrived eventually and so did the tachos on their desk, they’ve since been on the phone regularly begging for drivers, never again.
If you think you might need them again by all means do what you think is best, personally i think they are 99% a bunch of sharks with any sort of fair play being a one way street only their way and if they all went out of business, lost their homes and their wives ■■■■■■ off with their personal well hung trainers it would be poetic justice.

Agency’s use self employed contractors these days right? So when you are not driving, really you are unemployed - no holiday pay, no retainer, no pension, no benefits. Def wouldn’t lose sleep over notice period required if they’re not employing you or paying a retainer.
If you’re sitting there one day to next in quiet times wondering if the phone will ring then that says it all. If work is solid, they’ve been decent enough then maybe, but as said, I wouldn’t lose sleep over it. Sooner the downsides to these outfits of forcing people onto self employment shows its teeth the better.
In my own personal experience, never burn your bridges.
I left an agency a few years ago and did it correctly, but the job didn’t work out and he took me back straight away. I have recently left again after 8 years of being with him and I have left on good terms, as you never know…
