I am currently in a sticky situation, I have been doing some work since Christmas through an agency ( something I detest and vowed would never do, but had to bite the bullet and signed up with an agency ) and at the start they recommended said company Inland Solutions as they seem to have some affilation or scam going on. This set up doesn’t sit well with me, paying someone to basically look after my money to then give the taxman at the end of year if you get my drift. Thankfully I have now been offered a full time job and can leave the agency, but this is my question can I request that the money I have sitting with them be sent to me ? Anyone been through a similar situation or has done this ?

Having been self employed in my own right and had some PAYE jobs at the same time for over 25 years I’m not 100% sure how these type of co’s work, but I’m assuming they’re holding monies due to HMRC. So no, you can’t have it back because they see it (quite rightly) that you may well not pay what is due.
Where’s RobK when you need him? He would know about this me thinks.

I’ve no idea what he’s signed up for, but in general they should not withold any moneys from him. We’re not quite a quarter way through the year yet, he may have no tax liabilty at the end of it? Whats he gotta do, sow his tax bill at the end of the year before he gets his money back? Don’t think so.
the only moneys that can be held from a payment to you, is your tax/NI if employed ,or if self employed and/or sub contracting, the agency could tax you at source for which you would have a slip with your payment stateing this and how much ect has been stoped ?
as stated above it all tied in with HMRC though you would have been stopd the moneys they would/will have to make the payment and if their LTD then it will be a monthly payment by them if i remember correctly not yearly
It depends on what paperwork you were given. I they give you a payslip, stating what the deductions were for and the amounts, then they have to then pass this amount onto HMRC on your behalf. If, however, you have been given no paperwork then they either have to supply you with a P45 stating what tax/NI you have paid, or you get the money back for you to sort out yourself. If you’ve been working for them since Christmas, what happened at the beginning of April (the end of the last tax year)? You should have received a P60 from them, again stating how much tax you paid. This is necessary otherwise you would be unable to complete your tax return for the year.
you say you did agency from christmas. you could call the tax office and ask if they have received any money from this company for the tax year 2011-2012. this should have been paid by now.
if you have a record of what they’ve had off you, then you can see how much they may have pocketed.
the only money they should have is this tax year 2012-2013.
and if there is any money in the pot, then tell them you want it to offset against some legitimate expenses.
so what date did you finish with them?

2011-2012 wouldn’t, that would be overdue.
I’m still with the agency at the moment for 2 weeks, then finish thank god. I get the work from the agency then I am paid every friday by said firm Inland Solutions, they send an email and also text me the amount I am being paid ( and fairs, fair it’s always spot on and what it should be ) they send on an email which is a breakdown of what is deducted i.e Accountacy service fee and Agreed tax provisions. I was just wondering as I will be nowhere near the new tax threshold of £8,000 can I ask for that tax provisionback from this company ? I’m sorry I didn’t mention that my new job is not in the UK. I do apologise if all this makes no sense.

No I have only been doing this thing for a few months, a couple of days most weeks. I had my P60 from my former employer in April. But as I have said if I do get a tax bill for what ever reason I would much rather have the money put in my account earning me interest rather than this company if you get my drift.

Not sure how these umbrella type co’s work, but self assessed income tax for the year 2011-12 will not be overdue until 1st Feb 2013. My books haven’t even gone to the accountant yet.

2011-2012 tax returns were due in by april 2012.
2012-2013 tax returns were due in by april 2013.
however, you have until january 31st the following year to pay any tax liabilities.

The important bit for you at the moment is what paperwork you have received from them for the period from Christmas to April this year. Whatever terms you were being engaged under, you should have received something to clarify the situation, otherwise there’s no way you can complete your SA form.

Spot on.
Think you can even stretch it further (July?) if a payment schedule has been set up and at least one payment made before 31 Jan.
Totally agree with your 2nd poster in that OP should have had a statement from the co. sometime after 5th April.
