Agency Skulluggery?

Currently working via agency at Firm X
Paid £10.75 per hour
Receive email from agency showing new long term job offers
One job listed in the email pays £12.00 per hour and is based at the same location, doing the same type of work as I am currently doing for Firm X
I think same work, same location £1.25 extra per hour it’s worth enquiring about.
Phone up agency, explain situation e.g already working for Firm X doing the same work, agency spokesman seems cagey and tell me that they will get back to me after speaking to the client, I say why do you need to speak to the client - surely you already have the details if you are advertising for the positions? - They say “No we have to speak to client first - we will get back to you Monday”.
Although one other firm does operate from the same location it makes me wonder if the job being offered is with the same firm that I am currently working for. :confused:

Simple way round it get a mate to ring up saying he is looking for agency work might tell him than tell you,as they probably don’t want you jumping ship as if it’s a long term contract might be temp to perm then your not earning for the agency.

If it’s the same company is it even legal for them to pay individuals different rates?
If it’s a different company it still doesn’t seem fair for them to hold me back on the lower paid work.
Either way is crap!
I am a born sceptic and could of course be jumping the gun here, I will have to wait and see if they return my call on Monday after they have spoke to the client as they promised to.

Is it legal? Of course it is.

If it’s for the same job then refuse to do it at the lower rate or you walk. You would of course need to have the stones to back up the threat.

As you know the other company ring them direct and ask what agencies they use,if they use more than 1 register with the new agency.
Doesn’t sound right yours is holding you back definitely change agency if you can or apply direct to the new company for a permanent job.

Yes, it is legal but only for 12 weeks, if you work for the same firm for 12 weeks after the 12 weeks you have to by law be paid at the same rate as the firms drivers. It sounds to me that the job offered is probably the same job your doing at the minute, but is temp to permanent or at least a long term contract. They will be calling the firm to find out if they would be looking at taking you on a more permanent basis. That’s how I got my job. It gives the company chance to see what your like before they offer you a permanent job and like wise it gives you a chance to try out the job.

Also try to remember the agency have to keep not only the drivers happy but the companies they provide the drivers for. If it’s a longer term contract or even temp to perm the firm is paying the agency to basically recruit drivers for them so it’s vital that they ensure the firm is happy with the drivers they get. The advantage you have got is they have already seen your work so you have had in essence ae elongated job interview to show them your skills.
