Agency not paying me! need your help

It just shows you that agency drivers aren’t disguised employees as hmrc would have us believe with their IR35 regulations. An employee would have been paid for the 3.5 hours and then been put on sick pay, not been given nothing. I’ve done hundreds of agency shifts since I started driving Class 1 and have always completed my shift including doing any reasonable work that was requested of me. You could push the claim through the small claims court but for 3.5 hours work I wouldn’t have thought it would be worth the hassle. You’ve shown yourself to be an unreliable driver. In this game it pays to get a good reputation so that people want to book you.

When I worked for Canute on the agency, a Polish driver from a different agency turned up , refused to drive the truck he was allocated because it had a manual gearbox and he only drove automatics, and went home. He expected to be paid eight hours, Canute refused and to be fair, I took their side because even though I was an agency driver myself, and even though I prefer driving an automatic to a manual myself, it is not an unreasonable request to expect a driver to drive a truck with a manual gearbox.

So for me a lot would depend on having more information about why you went home, and I’m not entirely sure I understand the issue about the trailers?

Trailers weren’t that much of an issue. When i arrived at the depot from Volvo with the truck, the trailer (empty for collections) i was meant to take was getting washed so i went out to get the truck fueled up as it was running on empty and by the time i get back, trailer would be ready but it was taken by someone else. There weren’t any singles left so i had to wait for one to become available on the bays but i just went home as i wasn’t feeling great.

Sounds like an excuse coz you bottled it and didn’t want to take a double decker out

Transport office didn’t want a double decker on the job i was meant to do hence why he only wanted me to take any singles available.

I couldn’t care less what i’m taking out. As long as i’m gaining experience.

It was the 3rd day with this agency. I drove a class 2 for walkers transport, then got booked in for another company where there DAF had an engine malfunction warning and being a new driver and not knowing about DAFs, i felt uncomfortable in taking it out and then walkers again.

It may seem like it… with this agency only. I’ve done work for 2 other agencies and they know i’m reliable. Don’t judge just because of whats happened with this agency.

It seems fairly clear to me that the “I wasn’t feeling too great” only came about when he realised he’d done 3.5 hours of naff all and then would have to wait even longer for a trailer to become available, thus resulting in a 15 hour shift which he didn’t want to do. Walker’s will have spotted this obvious plot and informed the agency. Struggling to muster up any sympathy here.

Ah yes you were the engine malfunction fella. Can only judge on what you have said though/only as good as your last shift in agency’s or planners eyes.

At first I would have said the same as everyone else, letter before intent followed up by MCol claim. I have done this and it worked. I also had the golden bit of evidence in that I had a tacho printout for my days work and would always take one when working on agency.

However - if I wanted to build a relationship with either agency or company and I had come to work, done nothing and flounced I would take a hit for the day. As a serial flouncer in your case why would the agency want to pay as in their eyes you have painted yourself as a waste of time, someone to call if desperate and only to send into the clients they aren’t bothered about keeping.

Harsh words my friend but on this occasion I fear you may be correct

Maybe it’s just best to cut your losses and move on

Lesson learned

‘‘You had to’’ go to collect the unit and then back to get a fuel card and then out to fill it up then was told sorry no trailer wasn’t a case of ‘didn’t do any work’.
Sounds like they intended to cover a shunt from the garage for nothing.They obviously didn’t actually tell you how many drops and where and which trailer it was all loaded on.Because there was no load or trailer.
Your gut feeling then kicked in.
The answer in this case was before I collect the unit which trailer will I be taking when I get back with the unit and how many drops and where.
My guess is there would have been no answer because there was obviously no loaded trailer to take out.

With all due respect, you can’t really expect them to pay you then.

The issue about the trailers I still can’t understand. As an agency driver I’ve spent 8 hours sitting in the canteen before because a tractor unit, trailer or load wasn’t available, then gone home without turning a wheel. Of course, it is boring and I would rather have something to do but most agency drivers learn very early on to take a book to work to read in anticipation of this scenario.

I’m not being nasty but sometimes “tough love” is the best approach. Twice now you have aborted a shift due to no real fault of the client and the thing with agency work is that you are constantly moving up and down “The League Table of Preferability” according to previous performance, and you really do come across more as Yeovil Town than Manchester United. :stuck_out_tongue:
