Can anyone help out here? Got a call from the agency I do some work for saying that as I been there a bit my pay status has to change. I’m going in for a chat on Thursday but would like some info so I’m not going in blind.
He said they could offer me a contract to work for them but couldn’t work for any oher agency. Could work directly for them, go Ltd or ho through an umbrella company.
Can anyone tell me why this changes like this or advise me some…
After working for an agency at one company for 12 weeks you are entitled to most of the terms that regular staff get such as higher pay, if you now go on an agency contract or ltd you lose them rights. When you meet them they will try to con you with everything they can whatever you do don’t sign anything go away to think about it.

Under Agency Worker Rights after 12 weeks you are entitled to there perm staff rate of pay and other stuff.
So for example if you start with ABC Agency and finish with them 12th week but return to same client with XYZ agency you have be paid the after 12th week rate of pay aslong you never left. However if they make you leave to come back as a new agency or contract to avoid you getting your AWR stuff then its against the law.
Never go umbrella, you won’t have any rights, no sick pay or holiday pay. Ltd means self employed which they’d love cause you take all the risks and do all the work like paying tax an NI. If you are a union member, call them and ask advice. Unfortunately I am a greenhorn myself so can’t tell you any more. But I’m sure some of the experienced members on here will help. mac12 has given you some pointers there. Good luck!

Yes ltd your contract would be with yourself, umbrella you pay them to do your wages and agency contract you work for the agency usually on a regulation 10 contract saying that they will pay you so many hours per week even if no work but that would never happen. If things are good for you the agency wouldn’t tell you about it.
they told that after 12 weeks my hourly rate goes up (they gave me figures and can’t find them now), but they have not told me anything else. I wonder if they will say the same things?

The agency is a company out to make money on any work you do why would they give you something if it was good for you and bad for them.
Been reading up a lot today on how all this works. Spoke to a couple people at Umbrella companies as well. It’s definitely a good idea to get to know some if this stuff.
Of course they forgot. They also forgot to tell me that by giving me a measly quid more an hour to go umbrella I’d end up being a quid worse off by the time I take into account NI contribution and holiday pay

2 weeks same hours different pays
I notice that your last weeks pay is less due to the amount of tax & NI you paid, it might be the tax man taking more that has resulted in less take home pay and nothing to do with the Umbrella company?
I am also on Umbrella and likewise I am not sure if I have done the right thing by joining or not. Most jobs through the agency I work for pay an extra £1 per hour on Umbrella so if I average 40 hrs per week I figure I at least start out £40 up, however deduct from this employer NI and their fees of £17.50 and I am not sure if take home is actually worse, better or the same as PAYE, I am able to claim expenses for subsidiaries, mileage etc and it comes with some added perks such as free insurances. I have only been driving for 3 weeks and at the moment my take home pay is being distorted due to receiving tax rebates which I think is due to the fact that my previous job which I was made redundant from in July paid a much higher salary so I am waiting to see what my ‘real’ take home pay will be once my tax has been correctly adjusted.
Hey, ive been agency driver for 12 years, first as paye, then umbrella, now self employed + vat registered. Umbrella or S.E makes life a lot easier for changing agencies and working for more than one in the same week, basically means I take my own payroll department around with me wherever I go. I dont care about holiday pay, the pros far outweigh that.
S.E is better then umbrella, thinking back to it, umbrella wasnt cheap, S.E much better.
I’m only working a couple days of the week driving and looking to go self employed. I’d rather do it sooner than later and get all the paperwork out the way. Is it worth going S.E. For a few month till I’m ready to go full time hours? Is it feasible and how would I explain to HMRC only doing part time? Trying to get every angle covered as much as I can before I actually do it. I’m trying to know the trip ups before they happen …
