Just wondered if anyone had any experience of agencies not paying you if you have even the slightest knock? They usually claim that “The client won’t pay”.
Not that I am constantly having accidents of course…

You work for the agency, not the place you were/are driving for.
The agency should pay you as long as you turned up ready for work on the time and at the place they (the agency) specified.

Exactly, when I used to do agency driving, I had one or two knocks , but never did I not get paid for the job. Any agency that tries that on with you is definitely pulling your wire
Surely that is what insurance is for,as for agency charlatans if i worked for them i would want ALL TERMS AND CONDITIONS up front and in writing before it even came to that.

I’ve never come across an agency that didnt give you a copy of their T’s&C’s the day you sign up with them. But I wonder how many drivers actually read them before they actually bin them

If you ‘work’ for someone, you get paid full stop. Does a nurse/ doctor have their pay cut when a patient dies?
Irrespective of what your manual says, if you worked, you are legally entitled to be paid and no-one can take money out of you pay packet without you giving them permission (every time as well) other than CSA or a courts deduction of earnings at source.
Now, onto the bit about having a bump. If you are not being paid, you were not working for them. Their insurance will be for anyone who works for them (as an employee or sub-contracted to work for them for example, through an agency). If you were not ‘working’ for them, it means your journey must have been a social, domestic or pleasure journey and I’ll hazard a guess, they are not insured for that.
OK, now that’s out of the way. I would myself, if having a bump that was my fault, my stupidity or carelessness, probably not invoice for that day as a matter of courtesy if the damage was going to be expensive, but that’s a personal choice.
If they dont pay write to them and warn them you will take them to the small claims court and claim the pay plus any costs you have incurred, you WILL win, the haulier is insured and CANNOT legally pass the costs onto you unless you are numb enough to agree in writing to this. it is an illegal deduction.
REED BOARDALL expect their employees to pay the costs of accidents where they are to blame, if you follow that through to it’s logical conclusion if you say run into the back of a car (I know you shouldn’t holier than though ones)and do £2000 worth of damage, that’s £2000 out of your wages of £7,00 per hour.

The law basically say that they can’t make any unauthorised deductions, however if they’ve buried in the agency T’s & C’s (that you signed) a clause that they can withhold monies in the event of an accident or other issue. Then your probably stuffed, as in the haste to sign up to the agency you pre-authorised them to deduct monies as & when

Why should the company pay the agency after the driver has done a days work and smashed the truck up? The amount of times I have come back to my lorry after my weekend off and some lazy waster agency driver has scuffed the bumper, smashed the mirrors, used my maps and then left them over the floor with pages ripped etc etc, the list is endless.
So no, agency drivers shouldn’t be paid if they go into a place with a don’t give a ■■■■ attitude and beat up the equipment.

I do not and never will work for any agency, our firm do not deduct wages for any damages either.
i was paid,but im sure nightfreight took so much off of you towards accident[excess i think],it was defo in contract ,posted it on here years ago but cant be bothered to look for it

If anyone puts something in your Contract which looks unlawfull,go to a Legal Advice Bureau,becouse,as its in Austria:The Pay for the Work has to be paid in full,in such Case,but,for Damage the Driver seems liable he,the driver can be brought to court to claim the Amount of Damage.
But,it is unlawfull to keep Pay back as Deposite if not ordered by Court.
Pay can’t kept back till Court rules about keeping Pay as deposite if Date for Payment of Wages is earlier.
Don’t worry, ,I have a pretty Girl who knows the Law quiet good,and it seems the British Law is similar

Thats spot on. They can write what they like in your contract, if it aint lawful then they can’t uphold it.
i have never heard as much bullcrap in my life.
a company cannot lawfuly make a driver pay for damages. full stop

It’s happened with two agencies I’ve worked for - Intransit in Sheffield and another one in the center of sheffield which I’ve forgotten the name of.

It happened to me with one agency. I didn’t have an accident, I just didn’t get all my deliveries off.
The company apparently refused to pay the agency, so the agency wouldn’t pay me.
They called me a week later, to go back to the same place. I agreed to go, then accepted another job from a different agency and forgot to tell the first one
They eventually got the idea after the third job I didn’t turn up at.
