My mate works for a wastewater company driving a tanker,up until recently they were on domestic hours but now they are on tachos.the job is usualy about a 10hr day,with roughly 5hrs driving and 5 loading and unloading which consists of alot of manual pipe handling opening valves,monitering levels etc which I would class as other work,and my mate agrees,however he said that he doesnt take a break til hes done 6hrs because he says he hasnt drove over 4.5 usally about 3 by that point in his day,i thought that that when he starts his shift the clock would start and with all the loading accounting for other work he would require 45mins after 4.5hrs even if hes only driven 2 by then who is right its confused me
I think hes right. The way I understand it it’s a 45 min break after 4.5 hrs driving OR 6 hours work, which ever comes first.

If he was on domestic regulations before and the job hasn’t changed then he’s on domestic regulations still, the fact that he’s using a tachograph doesn’t mean he’s on EU regulations.
If he’s still on domestic regulations tell him to put the tachograph on “Out of Scope” and stop worrying about when he has his breaks.
If he’s changed jobs or the job has changed and he’s now on EU regulations, then he needs a 15 minute break before exceeding 6 hours working time or a 45 minute break before exceeding 4.5 hours driving time, whichever comes first.

He needs a break before exceeding 6hrs regardless of whether its in the scope of EU rules or not. The WTD (Mobile Workers) is entirely separate to the EU Drivers Hours Regulations and applies to all mobile workers regardless of whether or not they fall under EU drivers hours regs.

The working time regulations for mobile workers applies to drivers who drive in-scope of EU regulations and the travelling staff on such vehicles, drivers on domestic regulations come under the working time regulations 1998.
From memory the 6 hour rule in the working time regulations 1998 can be opted out of.
I am 99.9% certain the whole of the normal 1998 WTD regs can be opted out of but am happy to be proven wrong
