Advice plz Speeding M6 j5-j6 through variable speed limit?

I notice that the OP hasn’t returned to face his critics and reply.

He came through on the limiter and you’ve all been commenting at 40, no wonder you missed him! :laughing:

And how to get off on a technicality after putting on a public forum it was common practice to him.
Think that is when he lost any sympathy.

And getting off on a technicality shouldn’t be for rich and famous only…as was highlighted by some of you in a recent thread on here.

id think theres always going to be 5% decide to fight it, who go on to argue their case in court- on some crazy technicality, “wrong colour/ i wasnt as fast as they say / late for hospital appointment” etc etc. Id like to be a judge just for 1 day send someone down for 5 yrs ,just to see the face “take him down Sergeant”

There’s something not right here - surely the op must have wondered why most everybody else is driving kinda slow - like nearly 15 mph slower than him - it amazes me how it’s taken so long for the letter on the mat…

Personally I don’t think he’s going to get an offer - speeding HGV’s in roadworks don’t tend to go down too well.

I wasn’t looking for sympathy, just advise as its brand new to me.
I’d likely be criticising if it was someone else and not me.
Yes I’ve been a ■■■■ as others have said but for what it’s worth this is not routine for me but a genuine mistake backed up by the fact that never been done for anything ever since getting a license in 1991.
When I said" dragged through by the cruise control" l meant staying with the flow of traffic and not immediately piling on the brakes.
More a case of complacency than deliberately flouting the law but yes I agree I’ve done wrong l hold my hands up.

It’s not average speed here but variable speed limit so got logged at a fixed point. More likely the first gantry where it dropped from national speed limit to 40.

When I done Night trunking on the m6 the fudging things were going off like Xmas lights and no one seemed to give a crap.
I’m not saying the OP is in the right but when they set 40/50 and sometimes 30mph speed limits for no reason (and they do) people just ignore them.
I was constantly getting overtaken by people on the limiter particularly when the 50mph avg area starts. The majority of the trucks do it.

More likely a case of the driver cheerfully ignoring the 60 or 50 that always precedes the 40 and failing to notice the change to 40 :wink:

Variable speed,is for the overhead signs to be altered according to road conditions,NOT for drivers to vary their speed as and when they feel like it.
You got caught for your ignorance,take your punishment and let it be an expensive lesson learnt

As it happened, I got a letter from my local authority today and I quote the third para

“However, irrespective of the number of points you may have on your licence, it maybe beneficial for you to attend a DAS course and I am prepared to offer this as an alternative on this occasion.”

My licence is clean but it would appear that I could be an eleven pointer and still be afforded this courtesy.

Going back to the op, my authoritys website says the cut off is 53 in a 40 - above that it’s deffo points time.

Only new since the smart motorways were installed but if its got a circular speed sign then the cameras on the side are set to that. In some sections there are virtually cameras on every gantry, plus a few above the lanes.

Doesn’t mean the speed setting is sensible, but expensive to try to prove it was daft as you’d require expensive solicitors. At night there are plenty of times when its really daft.

Its not even really possible to claim it was a passing car as there are cameras behind the gantry which also takes a pic so would be easily verified by the lines on the road. Useful when the camera buggers up amd flashes for no reason.

Overall, just take it as an expensive lesson in these smart motorways and watch every gantry. Don’t just assume they are all set to the same thing as they do really insane things sometimes.
