Not always the case depends if local (i.e. company and drivers) agreement is in place the “10 hour if starting between 12 and 4am” rule can be disregarded.
Our firm has an agreement to this effect, not very often we start at silly o’clock though

Lots of companies try this nonsense especially tipping off the card. Tipping off the card is naughty, its not something i’d advise but be niave to say it doesent happen from time to time. The boss/tm sounds a complete halfwitt if he is asking you to drive without a tachograph, hows he or more to the point you going to explain the missing milegage if it ever came to VOSA being involved.
I had this nonsense a few weeks ago, not from my boss but from another company were pulling some trailers for. Gave me some extra work and expected my trailer on the boat for a certain time in the morning. When i told them not a chance, they went mental, going off the deep end, really needed it etc… in the end they arranged someone to swap trailers with me. Its not your problem if you run out of hours it is theirs.
A lot of bosses/Tm’s etc… will chance it with newer employee’s just stick to your guns, the fines and penalities are too large these days. Plus no doubt find if you stick to your guns get more realistic runs.
