Advice on my spedding charge please

got pulled in my the mrs’s car a few weeks ago doing an average spees of 98.5 over a mile and a half.
i have recived my letter for a court date but it says i can plead guilty by post,anyone any idea what sort of punnisment i could recive??
i dont want to plead guilty by post and then get a ban but dont know what to do.
id just got my licence clean aswell and i go and do this :imp: .

Unlikely to get a ban as you’re under the magical number of 100mph.

BUT, it sounds like even if you plead guilty, you’ll be going to court.

There is no defence unfortunately, rightly or wrongly you were 28.5mph over the speed limit, which isn’t mega far off 50% over :open_mouth:

Personally, I think the speed limits in this country are a joke, 70mph at 4am on a motorway on your way to / from work, just done a 15hr shift and you just want to get home, 20 miles at 70mph or you can just put your foot down and get home asap 120mph makes it a 10min journey +/-…

Depends on time of day, traffic, weather etc because all this will be brought up by the officer ‘witness’ on the court day, I was lucky with mine as it was ‘dry, good weather, not dazzling sunshine, rider stopped as soon as requested and seemed aware of his surroundings’, hence I ‘only got’ £350 fine + costs + 6 points :open_mouth:

He’s not been given a conditional offer - ie the points + fine listed in the letter - so he is attending court.

Pleading guilty or not guilty won’t change that fact, and you still get a chance to show how sorry you are even after pleading guilty.

If you plead not guilty, I’d expect to get shafted, they don’t like people wasting the courts time fighting absolute crimes - ie, caught, witnessed over 1.5 miles, pulled and most likely all recorded on camera and what you said at the time would’ve been taken down too.

I had this with my speeding ticket, I pleaded guilty by post, then got a court summons which I wasn’t required to attend, but was advised to go and show my face and make it clear that it was a mistake and admit I’d been stupid etc.

I expect this is what he’ll get, but I am making an assumption there, he may get an offer back through the post, but I doubt it for that speed, especially as he was pulled not just done by a camera.

I have to agree with you there waynedl :open_mouth: The idea that someone with a clean licence, plenty of experience and training, driving a large well maintained, very capable vehicle has the same limits as some dopey office worker in a tiny, tin can, gutless eco box with unchecked levels and tyres is ridiculous really. At 70 the eco box is struggling and so light it’s affected more by wind etc. Mine at 70 is planted and barely idleing :laughing: :laughing: :laughing: :laughing: 120 feels like 50 and being built for it means it’s a lot less noisy and edgy than 70 in a euro polar bear friendly ■■■■ box. :unamused: :unamused:

Seeing as the plebs are happy to slam anyone who has done well for them selves with “you’re killing the planet” taxes perhaps they should group cars with speed limits in accordance with capability :unamused: :unamused: :grimacing:

I drive a 530d estate, at 70mph it’s right on the bottom of the rev range for it’s top gear (5th auto), cruising around 85-90 is around 2000rpm.
It also has nice big grippy tyres, excellent suspension including air on the rear and nice big brake discs and pads, but has the same speed limit as a Fiat Cinquecento driven by a 17yr old who’s just passed their test.
BUT, as we’ve said so many times on these forums, rules are made for the lowest common denominator, ie a ■■■■■■■ driving a 25yr old ■■■■■■ with 1.6mm tread on their tyres and brake bads touching the ‘worn’ limit with knackered shocks so the tyres spend as much time off the road as on it.

Ok, I re-read what I wrote and see what you mean.

I would STRONGLY ADVISE him, that if he doesn’t get a conditional offer through the post, and gets the court summons which he’s not required to attend, that he should attend it.

MANY people have been banned for lower speeds than that or been imposed massive fines etc.

I knew a lad when I was driving taxi’s (minibusses) who was also PSV who had 28 points on his licence and was still driving PSV’s, sure his fines were massive, but he still had a licence due to attending court (and the boss attending with him) and putting his case forward

Ok, now YOU read what you’ve posted… I’ll put some of it up here for you…

If you plead guilty by post, your case will be dealt with in your absence and you will be notified of the outcome.
If you do wish to plead guilty, you should also remember that presenting mitigation is your right. Even if you do not appear in Court you should write a letter of mitigation outlining your particular circumstances.
If a mitigation letter is skillfully drafted it can often result in a substantially reduced punishment. Appearing in person may be a more persuasive way of establishing good mitigation with Court.

Scrap that then just trying to wake up

i’d attend court. but listen carefully to the charge that they read out.
you could plead guilty to exceeding the speed limit, then go on to explain that you was aware that you was over the limit, but certainly not 98.5.
explain that you don’t want to waste the courts time with having the traffic cameras independantly checked, your vehicle/police vehicle checked.
you could ask the court to take into consideration that you are a professional driver, and you are very capable of handling the vehicle in a much safer way than a none professional driver.
