I’m currently parked up in Brislington and parked up for the night. I’m worried about the safety of my lorry and contents(panels) as there is a lot of people around. I have done 12 hours today but the 15 is now up even though I had 2 hours driving time left. What is the law in this situation please anyone? I.e. Can I move without doing a driving offence…

You have done a max of 8 hours driving, if your talking about a 10 hour drive day, no driving offence, you will just get yourself a WTD offence. 15 hours, 9 off(reduced) or 11 normal. ■■■■ your load your safety and the public’s is more important

Have driven to Gordano services anyhow. Taking a 9 hour rest the will inform traffic office I’m morning. Thanks
If when you moved you were on 15hours your time was up end of.
There was no reason for you to move and I would think you’d be safer where you were than in Gordano.
It will be taken with a very dim view if stopped and if you had only gone 5 min back towards Keynsham onto the A4174 ring road there would have been space in a lay-bys.
What you have done won’t wash and I’d be very surprised if your transport desk would be ok with it .

I wouldn’t have thought Brislington was that bad, I can only assume it was around the back of Pets at home in the Dixon Road area, a bit of a hike to Gordano from there .

Brislington is ok. You got mucky D’s on the corner open 24/7 but that’s quiet by 11pm.

You broke the law to a proper taking the ■■■■ level. Your 15hrs was up so even though you had 2hrs driving time you had no duty time left. Lets hope you don’t get a tug in the next couple of months until it disappears off your card because you won’t get away with taking 30-45 minutes to get to a safe place to stop excuse where you were and where you ended up.
You won’t get a problem in brislington there is security driving round through the night if you try to park near the cafe on emery it’s pretty secure used to work out of a yard on that road even though we’re a bristol based company if we’ve got a drop on that industrial estate we often park up there as it a pain in the arsenal to get bak to our yard because of weight limits would rather park there than the services I also live 5min down road
The driver was concerned for his and his vehicles safety and so moved location - where’s the problem?
Make sure a print out is made and FULL details written on the back including the fact you were concerned for YOUR safety.
If I was your employer I’d be pleased you had thought about my wagon and load. I would still produce an infringement report and have you sign it along with comments of what happened then file it away with a copy of the printout as well.
Make sure you take the full amount of rest not including the bit where you first stopped.
In a roadside check they cannot fine you unless they catch you on THAT day. They need either four £100/£200 previous offences or one £300 offence to consider prosecuting you. So if you normally don’t have any infringements that makes this an isolated offence and not a problem.
Of course DVSA cannot check whether you were scared/frightened/worried and will accept what you wrote. They may ‘moan’ at you but so what.

the time he sat there was 2 hrs then decided to move also the distance you’ll find other vehicles also parked in the same area.

id love to have the same Christmas crackers where your getting your information from

What did you mean by there are people around, most likely they had no interest in your lorry and load ?
There were other places to park, such as Avonmouth industrial estate, which is free with night patrol by security guards .
Lockwood industrial estate in the Western side of Bath, which was a twenty minute drive from Brislington .
Not sure why Gordano was the option.
Gribbs Causeway has some space if you know where to find them near the big shopping mall or Nft/ Samworth brothers .
You shouldn’t have gone over 15 hours, you did not get nine hours daily rest, most likely 7 hours off .
so what would be the outcome if the OP had knocked somebody down, driving well over his 15 hours? doubt if the authorities would cut him much slack saying he was worried for the safety of his lorry.
Brislington has many housing estates in the area, the people around, sounds like teenagers in groups, around McDonald s , there are boy racers that meet up for a chat in the car park .
If you were near Ironmould lane, that has a reputation for drug users and its not lit up.
The industrial area for Ironnmould lane is shut off with locked gates at night .
Like someone else has said, if you had an accident and being over 15 hours, the media would interpret the story in to " Exhausted driver fell asleep at the wheel, killing family of four ,a menace on the road ."
When working time is up, that’s it, the truck does not move an inch .
If you got robbed where you were, so be it, that’s what insurance is for .

Just had to check I was actually sat at home and not the local Tesco RDC waiting room…

So long as you had a high viz vest on, you are invulnerable.

If I was his employer I’d be asking why he was potentially damaging my DVSA OCRScore and why it took him at-least 3 hours before deciding it was not a safe place to park.
I appreciate the the OP is a new driver (I believe so anyway) but I wouldn’t be encouraging him to do this sort of thing to often
