ADR quickie

Picture the scene: I picked up 2 plts of paint class 3 pg3. 1 plt weighs 330kg and the other 910kg. As I’m putting orange boards on, guy on forks sez its non ADR mate cos its under a 1000ltrs (1 was 200ltrs, the other 600ltrs).

Now I have always gone on the weight of the consignment when deciding whats in scope and whats not ie: pg1=50kg, pg2=333kg, and pg3=1000kg.

Any advice guys?

In all fairness to you mate, it’s not an employed driver’s job to decide whether the ADR Regs apply. (Unless you’re an owner driver, because of ADR’s definition of “Carrier.”)

Also, the method for deciding whether ADR applies to a particular job doesn’t work in the way you’ve outlined above, because Packing Groups (PGs) don’t always automatically take you to a load threshold limit.

I’m guessing that you hold an ADR licence, but I can tell you that an ADR course isn’t designed to train an employed driver to make this decision, due to the complexity of the calculation.
It used to be the case that a driver decided this, but that ended at midnight on 09/05/2004.

From your description, I’m going to guess that you were carrying:
UN 1263 PAINT, 3, PGIII (Am I correct and was this written on your paperwork?)
Another point that might be worth mentioning is that not all paint counts as dangerous goods.

The next thing I’d need to know (if the paint you carried does indeed count as dangerous goods) is how the paint was packaged AND what if any labelling was used. Equally importantly, what size(s) were the packages?
Was the paint in tins with lids like you’d buy in a shop, or was it in drums/jerricans etc?

Until I know the package type/size(s) I can only tell you that IF your load was in scope, the relevant figure would be the literage NOT the weight of the paint, because ADR counts paint as a liquid. (The weight is actually irrelevant in this case.)

If you can come up with the info I’ve asked for, I can give you a good answer to your question. :smiley:
