A REPORT about two German DRIVERS

HAVE just been reading this report on one of the sites I am on in Germany
and so I thought that I would print a short translation here as many people have stated that only UK or IRISH drivers are getting checked by the
enforcement officers, I have also put in the forum where it was posted that
the same should happen in germany but ,this is never going to happen
as the acctual lobby of the Transport would fight this tooth and nail
to ensure it did not getthrough,just like they are fighting and refuseing to except the WTD from BRUSSELS;

Last week in the UK ,two of my workmates were stopped and checked
where upon,the officers found numerous Driveing time offences and the Drivers could not show or prove that they had taken a weekend-restbreak
Therefore both drivers had a 24hr prohibition placed on there vehicles
and themselves,also each driver had to pay a caution of 3000pounds
which had to be paid in full before they where given perrmission
to carry on with their journey.

SO it shows that the enforcement bodies are doing their job,and please
carry on with the good work.

PLEASE TAKE NOTE THAT THE WORD ""caution “” means suriety or
a type of bailbond to ensure that the drivers appear in the court when asked for,

Is there such a thing as a caution of £3k■■? usually a caution doesnt entail a fine but is purely a “caution”.

Sounds like a load of crap to me to be honest.

the words in the german post stated a caution ,which means that they wish these driovers to appear in front of a court and this money will either be repaid when they appear or used towards the fine,FOR MY money it is a great
news as when the message gets back to the firms what costs they will have to pay for non complience with the laws of the land,will bring them to rethink about how they will go about their work in the UK,and so we just have to wait and see what the future holds,

I think you’re misunderstanding Pete. The word “caution” over here means that you don’t have to pay anything at all. It’s a caution, nothing more than that.

I don’t believe for one second that they will have to pay £3000 each. Even our own most hardened driver’s hours offenders don’t get fines anywhere near that; typically more like £500, so I don’t believe that foreign driver’s are going to receive more. Sorry if you don’t agree.

yes Rob k perhaps it would have been better if i had used the words suriety
or bailbond, the deposit of the sum of money is to ensure that the drivers will
appear in court or they lose thesum posted for non apperance,also if the court wishes they will then be asked for by useing the offical system,

You can bet your life the fine will be 3K also…how convenient that they already have it

can you read the post correctly first as the drivers did not have any money for fines with them they had to speak with their firm first who had then to send it through the bank system,

sorry you are correct i did not say that the money had to come from the firm in germany,but in all the years i have driven for german firms and driven to the UK,i have never had 3000pounds given to pay fines before leaveing the yard in germany,

The money had to be sent via the bankand the swift transfer system so as well as the 24hrs prohibition they could not leave until the transfer was completed, sorry but no one will have in his-her back pocket when traverling to the UK such a sum to pay any such fines when comeing from German.
Even the firms that run bent.

I dont speak German or Austrian so maybe someone could enlighten me to whats going on here am i to presume the word caution means deposit in either German or Austrian?.

I was thinking it was a BRITISH site that uses the English language to communicate with each other but after studying the rules apparently like my job now theres no need to have the ability to speak English .

I think what britpete is trying to say is, that both drivers were bailed to appear at a later date (Police Station or Court). With bail set at £3000 each

If you read the first posting in this thread it’s obvious the Pete found this item on a German forum and kindly translated it for us here.

The £3000 is as suggested above a bail bond to ensure that the drivers return to face the charges against them

The same system works in Germany if you are charged with a serious traffic offence you have to pay a substantial ammount before you are released. You then have to return to court at a latter date and plead you case in front of a judge who then sets the penalty. This has happened to someone I know.

As with anywhere in Europe until you pay the bail (or caution) you & your truck doesn’t move. The French are very helpful in matters like this and will run you to the nearest cashpoint machine if they discover a cash or credit card on your person.

A big thank you to all those who have either corrected my mistake with the wording , and after ROB had explained to those who did not understand ,I
returned to the post and added a extra sentence which stated what it was that the two drivers had to pay before leaveing,

Caution or Kaution in German means “Deposit”
Caution in English means “Vorsicht” in German said
As i read you Topic understood i that the Driver had to pay a Deposit before they could carry on with theres traveling.

does anyone remember the french driver who hit a coach head on at pontefract and killed the driver of the coach he just got sent home told to come back to go to court but never came back he was even in the paper sticking his fingers up laughing. :imp: :imp: :imp: :imp:

here is a update concerning the two german drivers,
THE CONTOL OF THE VEHICLES WAS CARRIED out by the police who escorted the drivers to the police station,according to the information i have been given ,they where taken before a judge who placed the 3000pound
caution/bailbond for EACH of the drivers, The money was paid through a banktransfer so they had to wait until this was paid and cleared in the bank
they also had a 24hr restbreak enforced by the enforcement officers,
It has been said that this was a first,but we must have members who remember the controls of the 1980 where this was carried out onthe spot with judges ,interpreters.and all the other people and items required

SO FOLKS IT SEEMS THAT THE WORM HAS TURNED
and let us hope the message gets through to those who push the drivers to
do the illegal actions.and stop it.
