A question that VAS may be able to help with

Vas, i have just read on the german site that I use about
the following story, the guy works for Monfort logistica
and he was takeing a workmate from Monfort transport
in his lorry, He takeing him home as it was on the way,
They where stopped and checked everything was okay until
the police asked why the 2nd driver did not have his card in the slot
when told about the fact he was not a member of that firm and was
just getting a lift home, they said this was illegal and fined the guy
€1500 for carrying persons not connected with the firm,
the police told the driver that it was not allowed to carry passengers
who are not connected with then firm,I am only repeating
what the guy wrote, ; VAS IS THIS true about such a law ■■? OR
not,■■?The guy also said that the police found nothing else wrong with the lorry and tacho,s, just the above point.

Not necessarily illegal but it would depend on whether the insurance of the company covers passengers who are not employees.
A good lawyer can get that fine back as long as the insurance is ok.
I usually give my drivers written permission as well if they wish to take a family member along just to be on the safe side.
There is nothing in Spanish law to say that you cannot give a friend a lift.

Hi Vas ; THANKS for answering , on the german site the answers fron some of the members is that they are perhaps doing the 2nd driver for not putting a card in ,However the driver has replied that this would have been wrong as the guy was
not a member of that firm he is going to post some more information later
hopefully a copy of the recipit for the fine payed with the reason in spainish why he was fined when /if he does I wil try to post it,I will tell him what you posted as regards the lawyer,once again thanks alot,

This basically is one of the reasons that we contract a specialist company to pay and administrate any fines that we may occur with our vehicles.
Their policy is to automatically fight and appeal every fine occurred
