A question about reducing rest

So this week has been
Mon 0703-2003 15 hours
Tuesday 0715-2030 13.25 hours
Wednesday 0530-2000 14.5 hours

So I have effectively reduced three time already by extending my shift beyond 13 hours but can I start after 9 off tomorrow morning or does the 9 off automatically start on Monday as I extended?
I don’t think I can but if I can do it and I’ve got it wrong I might as well get ip early and get some more o/t in

Hi Oliie - yes, you can start after 9hrs off in the morning. It’s your rest you’re reducing. The period you’re looking at here is the 24 hrs from when you began this morning - therefore as you’ve said, you’ve already reduced by not having enough of the 24 hours left to have 11 hrs, so you may as well get on the road and earning!

I agree with grumpybum, the fact that your shift was 14.5 hours today means that you’re on a reduced daily rest anyway regardless of whether you have 11 hours rest or 9 hours rest, so if you want to have just 9 hours rest you’re free to legally do so.

That’s it until after your next weekly rest period though as far as reduced daily rests are concerned

What she said^

Just remember that’s it for shifts of more than 13 hours, unless using split rests, until after your next weekly rest. I’m sure you probably know this but I mention it because a lot of drivers, having used all their reduced rest periods early in the week then go on to work over 13 hours on Friday, thinking it is okay because they are starting a weekly rest period.

I was correcting it as you posted

Ok thanks, better re set my alarm now
I knew my 3 reduced rests were up tonight just couldn’t remember if it meant 9 off or not I can come back here instead of asking next time my brain is mush

Hi … your quote as above seems to have answered a question I was about to post, but could you possibly clarify I am getting this right?.

If a driver worked:

MONDAY 07:00 START 19:56 FINISH
TUESDAY 06:55 START 20:24 FINISH
WEDNESDAY 05:25 START 20:21 FINISH
THURSDAY 05:55 START 18:33 FINISH

Then on FRIDAY worked 03:41 START 18:08 FINISH

An offence has been committed because daily rest has already been reduced three times and by working more than 13 hours on Friday this has caused a 4th reduction?

Thanks for any help

According to my arithmetic there have only been 2 reduced daily rests on Tuesday and Wednesday so no offence would be committed by reducing on Friday.

i think monday only had 10.59 mins rest

Yes Del I was just recalculating when I saw your post, there have in deed been 3 reduced daily rest period so it would be illegal to reduce on Friday

lost a rest all for one minute

if i were you i would whatch your times.

Sorry guys … seems I have mislead you with a typing error!! Tuesday start time was 06:56 which gets rid of the 1 minute reduction. But even if we left that in there - wouldn’t that make 5 reductions in this working week? (Mon 10h 59m, Tue 9h 1m, Wed 9h 4m, Thu 9h 8m and Frid 9h 33?)

MONDAY 07:00 START 19:56 FINISH
TUESDAY 06:56 START 20:24 FINISH
WEDNESDAY 05:25 START 20:21 FINISH
THURSDAY 05:55 START 18:33 FINISH
FRIDAY 03:41 START 18:08 FINISH (COMMENCES A REGULAR WEEKLY REST PERIOD)

I think I am missing something here

Yep, shouldn’t have worked more than 13 hours on Friday as he had used his three available reductions. Should have been finished by 16:41 latest.

Doesn’t matter that it his last shift before a weekly rest, he still needs 11 hours rest in the 24-hour period which began at 03:41 Friday and as you say he will only be getting 9 hours 33 minutes.
