I was doing my class 2 test today it was going well untill the clutch decided that it didn’t want to work couldn’t get the truck in gear so pulls over on the side of the road in a safe place, so after trying to get it moving again with no luck I get told that I should chalk this one down to experience and that I have failed so he gets out of the truck and just then someone who he knew drives past he flags them down has a quick chat comes back to me and says “he is going to give me a lift back ring your driving instructor and tell him where you are” and then just leaves me there so not been the best of days haha.
Bad luck mate.
I don’t see how a mechanical failure constitutes a test failure for the driver.
Also,the examiner leaving a driver on the side of the road in a vehicle he isn’t qualified to drive is pretty p#ss poor IMO.
Just something to ponder.
When I took my C1 as it was then, the brakes locked up on the trailer on the way to the test, meaning I missed my slot. The company who I had the tuition booked with, paid for my re-test as they said it wasn’t my fault, so they felt they had an obligation to meet, as the vehicle suffered a mechanical breakdown.
You may want to ask your tutor the same thing.

Unfortunately the examiner is in the right, they were also being a complete ■■■ and an arse. Your training company should pay for a retest, if they don’t name and shame them into getting some of your money back.
As you were unable to complete the test, he had little option. However, leaving you alone in control of a vehicle on the highway, for which you don’t have the correct entitlememnt to be in control of, is very dodgy ground and I would have though, constituted the old one of aiding and abbeting, which seems to have changed to ‘causing’.
The firm who supplied the truck have a duty to supply you with a vehicle in a fit condition for you to complete the test and are liable for any inconvieneince and costs incurred by their failure to do this.

Maybe you need to be more specific about the exact words the tester used? Did he ‘fail’ you or did he say that you couldn’t complete the test and for that reason, he could not class you as meeting the standards required blah, blah…
He was abit short on the details on what I was failed on he seem to be more intrested in grabbing a lift off his mate in the car but as the saying goes [zb] happens iv just got to move on and get stright back in for it.
A similar thing happened to a friends daughter last year, it was a car test and the car broke down, he aborted the test and left her on the road (well actually it was on a garage forecourt) in the car but HE took the keys and said he would give them to her instructor back at the test station. Not sure if it was right or wrong.

When a test is abandoned the examiner has every right to make his own way back and is allowed to leave the pupil behind, the instructor who is waiting at the test centre then has to make his own way back to the abandoned vehicle.
As for the test you can appeal but I doubt you’ll get any luck.
I know your a bit ■■■■■■ off that he left you… but bear in mind that someone else will have been sat at the test centre waiting for his/her test to start once your examiner got back, he can’t sit around all day with your broken down truck missing appointments.
I thought he seemed quite sanguine about it; you can’t pass if you can’t take the test though! With a bit of luck, he might have failed anyway and will get a free retake and the chance to put things right.
I’m sorry things went wrong for you and understand that you’d be a bit ■■■■■■ off about it but in my opinion the examiner did nothing wrong in leaving you with the vehicle, as has already been said there may have been other tests booked so he would need to get back to the test station, apart from that there’s nothing he’s going to do about a vehicle that doesn’t work, it’s not his problem or responsibility.
What happened when the instructor got to you, was he ale to drive the vehicle or was it towed in ?
