One of our drivers was in a 7.5t going to spalding when a VOSA car followed him and pulled him for a check .He was ok for the tachos but because he drives vans as well they asked for his log book which he never keeps so they made him stay in the wagon for 45hrs because he could not prove he had had a break .The boss showed the other drivers the probation ticket this morning as a warning to us,we are self employed so accurate record keeping is a must if only to check the wages
“the driver must remain with the vehicle for no less than 45hrs ,failure to comply or moving the vehicle will result in a £5,000 fine”
During a break or rest period a driver shall be free to dispose of his time as he wishes. How do they reconcile this with making him stay with the vehicle?

Although no mention of yellow chalk ect, They could not insist that the driver remain with the truck for 45hrs it would be a breech of his or her human rights for one thing, they may not have food &water, and what do they expect the driver to do for toliet facilities ? i smell bs

I was pulled by Vosa on the 14th June last year and they parked me up for a week because both of my headlight bulbs had blown and there was no way of getting any replacement ones out. So to make sure I could get back to base within the maximum day light hours that god gives us, they made me wait until the 21st June.

They can prohibite the vehicle and stop it moving, the same does not apply to the driver, VOSA cannot ever stop a driver leaving a vehicle- this tale simply is either incorrect of along the lines of other drivers bull manure-
Think I am wrong? look up the powers of arrest , dentention that VOSA have over people it is very limted

I did correct it if you bothered to read to “must remain on break” or similar wording ,not, must remain with the vehicle ,the fact he stayed with the vehicle was because he was 200 miles from home and didn’t have much of a choice

Vosa had me once for not having sufficient weekly rest.I am a school bus driver and some days only work for 1 hour in the morning and 1 hour in the afternoon.The man goes through my tachos and says not enough weekly rest as I had driven for a Wedding on the Saturday and had taken a bowling club to an away game the previous week.I asked how can I earn a wage only doing about 24 hours over 6 days.Rules are rules and I was forbidden to drive for the next 2 days ensuring that I had my statutary 45 hours rest.
