My mate is is asking the following question on FB Can some one please answer this for him many thanks.
Question if any one knows if I work a double man shift and do 16 & 3/4 hours how many hours rest do I have to have off 9 or 11
9
Many thanks
as Joycey said, it is 9
the reason being, whilst driver 1 is driving the last stint, driver 2 is already on his/her daily rest
the following morning, driver 2 becomes driver 1, and when the new driver 1 is driving, the new driver 2 is finishing their daily rest

Daily rest can only be taken when the vehicle is not moving so if driver 1 is driving then driver 2 cannot be on rest - break = yes but rest = no
ROG, IIRC, it is slightly different for the double manning rules, as it used to be an 8 hour break

Nothing to stop the driver who done the last stint on day 1 doing the 1st stint day 2. Or even both having 9 off and starting single man shifts.
I think you’ll find Rog is actually correct in that a daily rest can only be taken in a stationary vehicle, even when double manning.
Years back I double manned to southern Spain for a short while and on occasion we would work it so that driver one started his rest period while driver two did his last stint behind the wheel. If pushed to the max, bearing in mind the rules only required 8 hours rest back then, the truck only stood for 3.5 hours. At a cursory glance the cards looked good apart from the fact that one rest break would have a mark where the cards were swapped. If examined more closely as a pair of card under double manning regs things start to fall out of bed in a big way.
We always got away with it mainly due to only ever getting checked in Spain and at that time the Guardia civil only appeared to check that the required amount of rest was marked on the card.
Cheers
