6x24 hours

What does this really mean

A weekly rest period shall start no later than at the end of six
24-hour periods from the end of the previous weekly rest
period.

Lets see, this is the way I see it, it means that if you have a weekly rest in the week and it starts by the end of the 6th 24 hour period your fine.

VOSA use the term as 144 hours but that’s just a guide and as we no it as no legal standing in the law, because Vosa would use the EU regulations 561/2006 as defence on any infringement and not the guide.

Also as I have noticed from others on the forum a rest mid week does not have to count as a weekly rest if the driver takes a rest at the end of the week as two rest can not be counted as a weekly rest in the same week( there nothing stopping you taking as many weekly rest in a week but only one would count, I should know that cos I made that mistake loads of time and be pointed out by members who know, so I for one admit I have been wrong)

So how does the 6x24 hour weekly rest work well this is my opinion( I am sure I get a know down if wrong :stuck_out_tongue: )

If in week 1 you took a weekly rest on say Saturday at 9 am, and came back to work on Monday at 6 am, that rest as been counted for week 1’s rest, your next required rest would be required by 6am Sunday (but in fact if you start at 6 am every day in that week you would have to be of the road by 19.00 on Saturday if you only have a 11 daily rest left or by 21.00 if you have a 9 hour daily rest left )and then you take 45 weekly rest, this rest is for this week, week 2

But lets look at it in this way, you have had you weekly rest for week one of 45 hours, and you come to work at 6 am Monday, Tuesday and Wednesday as normal finish work at 19.00 Wednesday you take 35 hours rest which takes you to 6 am Friday then do a 13 hour duty day and take a daily rest of 9 hours, and start work at 04.00 sat morning, and finish the day at 9.00 am, and get told your back to work Monday at 6 am, you have 45 hours weekly rest, and you class this as your weekly rest for week 2 the rest of 35 hour mid week would not need to be compensated cos you have have two 45 hour rest in two consecutive weeks.( the 35 hours rest that was taken mid week could be classed as the rest for that week if you carried on working for the next 6 x 24 hours and that 35 hours rest would need to be compensated by the third week following the week in question)

How did I do and did I get it right :question:

I would like to add something, the quote above as no barring on the amount of work that can be done in the 6x24 hour period, that would depend on how much driving and daily rest have been done or taken

I can only ASSUME that those that made the law decided that the phrase 24-hour period would be understood by all across the EU.
I suppose one other option would have been perhaps - A day (but that would probably require a definition as to what a ‘day’ was and when that ‘day’ was deemed to start & finish as most would probably think that a ‘day’ went from midnight to midnight)
I don’t think there is a better way to put it that would not cause confusion.

As for the rest of your post - I cannot see anything amiss but I’m not the expert :smiley:

  1. The “daily working period” within the meaning of Article 15(2) of Council Regulation (EEC) No 3821/85 of 20 December 1985 on recording equipment in road transport, comprises the driving time, all other periods of work, the period of availability, breaks in work and, where the driver divides his daily rest into two or three separate periods, such a period, provided that it does not exceed one hour. The “daily working period” commences at the time when the driver activates the tachograph following a weekly or daily rest period, or, if the daily rest is divided into separate periods, following the rest period of at least eight hours’ duration. It ends at the beginning of a daily rest period or, if the daily rest is divided into separate periods, at the beginning of a rest period extending over a minimum of eight consecutive hours.

  2. The term “day”, within the meaning of Council Regulation (EEC) No 3820/85 of 20 December 1985 on the harmonization of certain social legislation relating to road transport, and of Regulation No 3821/85, must be understood as equivalent to the term “period of 24 hours”, which refers to any period of that duration which commences at the time when the driver activates the tachograph following a weekly or daily rest period.
