Hi if a driver is at home all week but required to come into work and drive if needed between 1800 and 0600 each day can that driver only do this for 6 days? or is it ok for the driver to do this sunday to sunday? i know that would mean its 7 days which isnt allowed however if the driver didnt drive or go into work for lets say the monday tuesday and wednesday would that be an exception? cheers.
The usual rules would apply. If he is on-call then he is not free to dispose of his time however he wishes so this can’t legally be a rest period.

Don’t think in terms of “days”, think “24 hour work periods”. For example, despite what some drivers might believe it is perfectly legal to have seven “days” showing on your tacho, if you’ve had a 24 hour (minimum) rest period after 6 consecutive “24 hour work periods”. for example, driver finishes his 6th day on Saturday morning, say 11am, then starts work again on Sunday evening at say, 8pm. Seven days showing on his card but perfectly legal (for that week).

He would be on call from 1800-0600 each day starting from sunday 1800 and finishing the following sunday 0600, i just didnt know if POA which the driver has been told to use between 1800-0600 would count as a break if say for 2 days the driver hadnt been called into work, its the not beeing able to freely use the time which is the factor i think, he can do what ever he likes but has a 1 hour peroid to get to work if needed

You could theoretically start a weekly rest period at 0100 every Saturday, take 45 hours off, start again at 2200 Sunday and do this every week. So you could legally work 365 days a year.

its rotated through 7 drivers thats all
