48hr week 17 week rolling period

Whats the score with this. I do around 58 to 63 a week including breaks surely I’ve exceeded the 48 average.
Any info please, also who enforces this?

Breaks and poa don’t count.
You should be able to ask your transport office what your average hours currently are.

You’re not supposed to average more than 48 hours working time per week over the reference period, so whether or not you’re exceeding that depends on how long you’ve been doing 58-63 hours a week and how many of those hours count as working time.
Working time does not include breaks rest or POA.

The DVSA are charged with enforcing the RT(WT)R but they tend not to bother, as things stand at the moment the only time you’re likely to be charged with working time offences is if they’re used to back up charges of none compliance of the drivers hours regulations in court.

It is also the employers duty to calculate WTD not the drivers responsibility as it is deemed that drivers do not have the facilities to do it
