i worked monday to sat last week and trained for my class 1 mon to friday using my digi card am i now correct that i have to have 48 hrs rest or can i work saturday ( failed my test miserably for c+e today i suffer really bad with nerves days before and didnt even get off the test centre car park after a shocking reverse) gutted ![]()

Hi Mate, sorry about your bad news, nerves can be crap cant they, dont let it get you down feller, next test you will have an idea whats expected so hopefully you wont worry as much, dont think many people pass first time so dont feel bad just look on it as another driving lesson & soldier on with it, you will get there eventually its only practice that you need. As for you question regarding weekly rest you can reduce it to 24 hrs i believe but must compensate by end of third week following. Good luck with the lessons mate. all the best ![]()

Well you haven’t worked, so as far as I’m aware you can work Sat and Sun if you wish. I’ll prepare myself to be told otherwise!!!
Why did you use your driver card whilst training ?

EXEMPTION -
Vehicles used for driving instruction and examination with a view to obtaining a driving licence or a certificate Professional Competence (CPC). provided that they are not being used for the commercial carriage of goods or passengers.

As far as I know you don’t need an operators license for a vehicle that’s used exclusively for training so presumably the vehicle is used at times for the carriage of goods which I think would mean it’s always in-scope of EU regulations unless it’s being used under domestic rules.
The bit about having to use the card because you’re a qualified cat C driver is as far as I’m aware complete nonsense, but as the vehicle is most likely used on occasions for the carriage of goods it’s probably not exempt from EU regulations and obviously you would have been driving on public roads so you wouldn’t be exempt either ![]()
As far as the weekly rest question is concerned I assume you had a reduced weekly rest before starting the training in which case you should have a regular 45 hour weekly rest period this week.
If you did in fact have a full 45 hour weekly rest period last week then you can have a reduced weekly rest this week, a reduced weekly rest period should be at least 24 hours.
By the way a regular weekly rest period is 45 hours not 48 hours ![]()

Then it’s the same rules as if you were on annual leave - nothing on the tacho counts - if you did use your digicard then you should have selected OUT OF SCOPE - do printouts for each day and explain that it was OUT OF SCOPE LICENCE AQUISITION TRAINING.
What the vehicle is being used for determines whether or not it comes under EU regs - the O licence etc etc has no bearing on this.
There are some training schools that use their trucks for ‘normal work’ so those trucks are required to have an O licence
Some companies do the training in their own trucks and the trainee does deliveries whilst training so that would be IN SCOPE of the EU driver regs

Did they not give you the opportunity to complete the driving test? I thought they give you the chance to finish even if you fail early on in the test,just so you can get a feel for what is expected next time. ![]()

From the end of your last shift in your usual driving job to starting the first shift after training would all be regarded as rest
