48 Hour Rule (AGAIN)

Morning everyone,

I am really sorry to bring up this question again but have my lessons, test and mod 4 coming up at the end of the month and may have the opportunity to start working Ad Hoc the next day as I already have my digi card.

If I have worked this out right I believe that even though I am in full time work at a school (so term time only) I will still have possibly every other weekend to gain some experience with a view of joining the haulage industry full time next summer :slight_smile:

So here goes put on your maths caps and let me know what you think, as I say I work term time only so get all the holidays off,
now according to the DVLA the 48 hours is worked out over 17 weeks (as I read it), we started school on the 3 September 2015 so 17 weeks takes us to New Years Eve exactly so I am not working for 3 weeks of the 17 now here’s my theory as follows;

Monday to Thursday 0800 to 1600 = 8 hours
Friday 0800 to 1530 = 7.5 hours
Total = 39.5 hours

Now take away 5 hours for lunch = 34.5 hours

I also get a 15 min break each morning where we retire to the staff room so that comes to 1.25 hours a week, so 34.5 - 1.25 = 33.25 hpw

Now time 33.25 hpw by 14 which is the number of weeks I am working over the 17 week period = 465.5 hours

Now divide that by 17 which is the period the DVLA say its worked out over 465.5 / 17 = 27.38 hpw

So if I am correct surely I can work every other weekend as I have almost 21 hours spare ■■? Does this sound right as I will ask my driving instructure at then end of the month but didn’t want to look a nob if I’m completely wrong.

The school work is under the normal WTD (which can be opted out of entirely) and the driving is under the RT(WT)R and the two do not get added together

The school work counts as other work under the EU tacho regs so cannot count as rest so if working mon to fri then you can generally drive for one day every other weekend

Sort of Rog I think, I just thought that as I worked Monday to Friday I would have to account for it when it came to driving a rigid,
even though I am under the 48 hours ■■ I thought I would be able to drive for one full weekend then have the next one off ■■

Not for WTD regs but it will for tacho regs

Omg! Who in the right mind would administer their non driving hours? May I suggest. Keeping it simple, keep your driving hours on your Digital Tachograph Card and your school hours to yourself. [emoji41]

But being a newbie I would hate to get caught out and lose my licence straight away :frowning:

If DVSA suspect that a driver may be doing another job and not recording it then if its on the books it is an easy check to do with HMRC

I’ve been pulled once in 20 years. It’s worth the ‘small’ fine, ‘if’ they check.

stanin grimbsy for gods sake if you are a teacher, i doubt.your not very clever.you will never make a driver.to much crap about breaks in school come onyou think you know it allreadyhours wise only .blokes like you messed the haulage industry up by doing the odd weekend.

Just an observation but if you are currently a teacher then why on earth do you want to go and drive a truck for a living? You have a recognised and skilled profession, one which is challenging and respected. You must be on an excellent annual salary, proper pension and serious paid holidays and a 5 day week! Why do you want to give all that up to work 15 hour days / nights / both, weekdays and week ends, low to mediocre pay in comparison to what you earn now (for working Monday to Friday,starting at 8am and finishing at 1530-1600), and maybe a pension if you are lucky but nothing like the one you will have now!
I understand what the appeal maybe but seriously, do some homework (pardon the pun :smiley: ) and think long and hard about what you are giving up! If I was in your shoes then I would go for the licence then sign on for an agency in the term time holidays. In my experience the grass is NEVER greener. It is usually still the same old grass. :wink:

Can we get one thing straight please folks ‘I am NOT a teacher’ I just work in a large primary school doing IT and as the head is retiring we are being taken over by an academy sponsor and my position is under serious threat, hence looking for another option and trying to get experience before September next year.


And as for the comments raised by deckboypeggy,

A. I have never claimed to be a teacher (we have 105 members of staff at the school and only 35 are teachers) there are other people work at a school other than teachers you know.
B. I don’t claim to know all about the hours at all hence I’m asking the question (in a section called 'New and Wannabe Drivers)
C. I really don’t understand how I have managed to ruin the haulage industry when I haven’t even got my Cat C yet ■■?

And whilst I’m not the type of person to judge people and cast aspersions on their character I’m sure deckboypeggy you must be highly intelligent and should you ever want to be in the IT industry would not need to ask any questions regarding such trivial things as DHCP, DNS, WINS, Mesh Wifi topology, Network Infrastructure, Routing and Remote Access etc… let alone the fundamentals of 801 and 802.

And please don’t get me started on you grammar and punctuation.

Thank you for the comments, sadly as stated above not a teacher I’m afraid but I do appreciate what your saying.
As for the driving I think I will take your advice and look at it more as a holidays job rather than weekends :slight_smile: with the intention of going full time in the summer :slight_smile: , I do know a couple of people high up at DFDS and DSV so might try them before the agency, but thank you anyway.

You can ignore the WTD 48 hour average because your ‘other work’ (that is work outside of the transport industry) does not count towards it.

However - when you do drive you will need to make sure you carry records of the ‘other work’ in the form of a Tacho disc or digital print out with the date, your name and start and finish times written on for each day of work. They don’t need break timings etc - just start and finish times. You can probably get away with a time sheet type document but technically not.

You must have records of any ‘other work’ completed in that week prior to driving - so if you drive Saturday you’ll need records for Monday to Friday.

You must have any legally required records for the previous 28 calendar days with you.

Ignore the advice to not bother with these records. The fixed penalty is £300 and normally accompanied by a prohibition whilst they wait for the missing records followed by further enquiries back at the operating centre at a later date. Of course you may not get stopped at all but the operator won’t thank you if it does all go wrong.
