45 minute break deduction

It’s been a long time since I’ve been hourly paid which also includes a 45 mins a day deduction.
What I want to know is, is the 45 deducted from the basic or the overtime rate?

Basic normally.

Overtime is just extra on top

they always take 45 off at highest rate, ie saturday start at noon, finish at 00.45 sunday
guess when they take 45 off?

How the ■■■■ can they get away with that ■■? If you’ve done those sort of hours, you’ve had your break on Saturday, not Sunday!!!

How the [zb] can they get away with that ■■? If you’ve done those sort of hours, you’ve had your break on Saturday, not Sunday!!!

If I was working on tesco shift I would try finish before 8 hours . If not next delivery would take an hour longer

It doesn’t matter WHERE it’s deducted, the net result is the same.

Start 0600, finish 1800. 12hr shift.
Deducted 45 mins at normal time for lunch = 11.25hr shift (assuming overtime after 8hrs) 3.25hrs overtime
Deducted 45 mins at overtime rate for lunch = 11.25hr shift (assuming overtime after 8hrs) 3.25hrs overtime

The reason is, deduct it from your normal rate, and it just pushes the time you kick into overtime back to 8hrs 45mins. Or deduct it at overtime rate, so your overtime started at 8hrs, but at 8hrs 45 you finish, you still get paid 0 overtime.

The easy way to work it out is go and work for a company that pay breaks. Result

Or take it back by getting your head down for a bit on cross hammers

I’ve never worked anywhere where the breaks are taken from basic rate.

Let’s say you work a 40 hour week, so for 5 days you’re going to work 8 1/2 hr shifts, 30 minutes stopped per day for breaks and you’ll be paid 40 hours at basic rate. Do you really think anyone is going to pay you 37.5 hours basic rate then 2.5 at overtime rate?? Not going to happen !! :open_mouth:

I have been since January, the company was sold and the new owners say they are going to deduct 45 mins a day…hence the question.

Yes, but if you do 6 hrs, you get 8hrs pay, not 7 1/2hrs.

Yes, but if you do 6 hrs, you get 8hrs pay, not 7 1/2hrs.

This type of employer will always find a way to cut costs and ripping off employees is one of them.

This question pops up quite often. The way I see it is if you get paid time and half after 8 hours then the company will add up all your hours, subtract 45 minutes or 30 minutes or whatever then pay you accordingly.

So a 12 hour shift minus a 45 minute break would equate to 8 hours at time and 3.25 hours at time and half. You’ve worked a total of 11.25 hours of which the first 8 are paid at time and the rest time and half.

When you actually took your break doesn’t really enter the equation.

Never bothered me if they deducted breaks on either full time work or agency just fiddled the 45 back, there was a company near Leeds G McFarlan transport (yellow and green trucks) ■■? years ago that knocked of an hour during a normal shift and if you did over 12 he would knock ANOTHER hour off, needless to say I refused a job with them.

Asda pay you the whole time you’re on shift, including your break.
