This was mentioned in the use of the third lane of a motorway in certain circumstances thread on the PDF and I though it might be of some interesting debate

Not easy to find to any information on this, but my guess is that only the outside line would be prohibited as for motorways.
If it’s not a motorway classification then you can use any/all lanes. A46 round Warwick and the North Circular spring to mind.
It’s only motorways that have a restriction on the outer-most lane (assuming 3 or more lanes).

I don’t think you will as there are not any restrictions - they tend to only tell you want you CANNOT do - it would be like legislating that you CAN drive in lane 1
Thats true Rog, but I can’t even find anything about motorway driving either! I draw the line at having to go up the loft to get my CPC books out!
It’s one of those things that are not specifically mentioned - one of my favourites is - You must be in full control of your vehicle - it does not say that you have to use your hands to do that

Here you go, number 265. Only applies to motorways not A roads. I regularly go in the outside lane of a 3 or more lane A road, at least a couple of times a week on my regular routes. The exit from the Dartford tunnel and the road after the Dartford bridge are two places where I use the outer lane. The A55 coming down from Holyhead toward Chester where it goes to 3 lanes as it climbs the steep hill is another, usually got a couple of trucks crawling past each other in lanes 1 and 2 and I nip past in lane 3. At all those locations, on at least one occasion, I have been seen by the police in the outer lane and never had a problem, which is a pity as I would love the argument with some numpty copper.

The Motorways Traffic (England and Wales) Regulations 1982
12(2) Subject to the provisions of paragraph (3) below, no vehicle to which this Regulation applies shall be driven or moved or stop or remain at rest on the right hand or offside lane of a length of carriageway which has three or more traffic lanes at any place where all the lanes are open for use by traffic proceeding in the same direction.

Err, yes it does. It’s in the link in my previous post. Here is the quote directly from the Highway Code - see the bit I’ve put in red, bold, itallics.

The right-hand lane of a motorway with three or more lanes MUST NOT be used (except in prescribed circumstances) if you are driving
- any vehicle drawing a trailer
- a goods vehicle with a maximum laden weight exceeding 3.5 tonnes but not exceeding 7.5 tonnes, which is required to be fitted with a speed limiter
- a goods vehicle with a maximum laden weight exceeding 7.5 tonnes
- a passenger vehicle with a maximum laden weight exceeding 7.5 tonnes constructed or adapted to carry more than eight seated passengers in addition to the driver
- a passenger vehicle with a maximum laden weight not exceeding 7.5 tonnes which is constructed or adapted to carry more than eight seated passengers in addition to the driver, which is required to be fitted with a speed limiter

Obviously it isn’t just in the Highway code as that in itself is not law, only guidance to dozens of other bits of legislation, such as The Road Traffic act, in a simplified, easier to understand, format.
