3 Hours, split rest!

So, I’ve been sat 1:41 mins break, then moved 1 min drive, then 1:20 mins break, would you still use it for a 3 hr break?
If you did are VOStapO likely to get giddy over it?
I know it has to be continuous, but will less than 60 seconds get you a fine?

It certainly would not be legal to use that for a split daily rest period, but whether or not VOSA would let you off I’ve no idea but I somehow I doubt it.

If you use those breaks to work a 15 hour spread-over and you don’t have a reduced daily rest period available you would certainly get an infringement when your card/chart is analysed.

Apart from anything else the fact that you had to move the vehicle sort of suggests that you was technically on break rather than rest and a pedantic VOSA bod may pick up on that.

On another point regarding infringments, if you got pulled and had an infringment and got a verbal warning for it, then got stopped again a few days later, would VOSA know you have had a verbal for it, or could the second one do you for it?

You could always say you were not in the truck (gone for a pee?) and someone else moved it.

Legally you can only be penalised once for an offence, it’s never happened to me but I believe VOSA can give you a form to say that the offence has been dealt with, it would be on their records anyway.

Depends how ■■■■ the vosa bod is.

I know its naughty but if you eject your card - then move the truck - then put the card back in again when you are ready to go - make a manual entry you have been on break it should show a 3 hour uninterrupted rest

Dont think that would matter, can just do a manual entry or just attach a magnet and be done with it.

I wouldnt lie, just tell them why you moved it. I dont think it would go down well though because as others have said you were ment to be resting and the fact the truck was moved could suggest you were doing other things on your supposed rest period!

Class it as a split daily if you really have to but if you get stopped expect to be fined.

If I got fined, I think i would invest in a magnet.

The last truck I drove in the UK was one with the newer version of the digital tacho and I know that if I moved slowly off a bay and didn’t go too far it didn’t interrupt my break/rest with a minutes ‘other work’. I’ve used that more than one to tot up 3 hours. Who cares if its legal to the letter of the law, we’re expected to behave like human light bulbs with an on and off button with everything we do with regards all this pathetic over regulation, I say do and take as you can for your own benefit as its not often a modern day EU pre-programmed truck operative clone can do so.

Yes you can, you just do a manual entry when it goes back in.

And if you got caught doing that, you’d get a lot more than a fine.

How do you mean? does the law say the card has to be in to record a rest break?
