24 hour daily period & driving/working

Just need to make sure about drivers hours & daily rest after overhearing a discussion between drivers.

If a driver starts at 06:00 on Monday & drives/works for 13 hours & then takes a 9 hour reduced rest does he need to wait until that 24 hour period is complete before starting work again.

i.e can the driver start work directly after the 9 hour rest or does (s)he need to wait until at least 06:00 the following day to comply with the rules? In essence being forced to take an 11 hour rest.

A new 24 hour period begins when you start the next shift, so in answer to your question, no you don’t have to wait until the 24 hour period is complete, as soon as you’ve completed the required rest period you’re free to start another shift.

Thank you tachograph. This is what I thought but I must say I did doubt myself when I heard these drivers talking, so I felt I’d better clear it up by posing the question to the experts on this forum.

Be careful using the expression spreadover time until you understand it,
It is only old ■■■■■ that use it, like we still talk about ten bob notes :wink:

Working 13 hour or 15 hour spreads only means you are attempting to take either 11 or 9 hour breaks.

The Horse says this;

Daily rest periods
A driver must take a daily rest period within each period of 24 hours after the end of the previous daily
or weekly rest period. An 11-hour (or more) daily rest is called a regular daily rest period.

Driving + other work + breaks = 13 hours
Regular daily rest 11 hours

A driver may reduce his daily rest period to no less than 9 continuous hours, but this can be done
no more than three times between any two weekly rest periods, and no compensation for the
reduction is required. A daily rest that is less than 11 hours but at least 9 hours long is called a
reduced daily rest period.

Driving + other work + breaks = 15 hours
Reduced daily rest 9 hours

Example

To summarise, a driver who begins work at 06.00 on day 1 must, by 06.00 on day 2 at the latest, have completed either:

  • a regular daily rest period of at least 11 hours; or
  • a split daily rest period of at least 12 hours; or
  • if entitled, a reduced daily rest period of at least 9 hours.

Where a daily rest is taken, this may be taken in a vehicle, provided that it has suitable sleeping
facilities and is stationary.

Here’s the appropriate section of “Regulation (EC) No 561/2006”:

Article 8

  1. A driver shall take daily and weekly rest periods.

  2. Within each period of 24 hours after the end of the
    previous daily rest period or weekly rest period a driver shall
    have taken a new daily rest period.
