2 hrs maximum deviation from set start time

I’m being told you can only deviate by 2 hrs from your start time
I.e start time 11 a.m ,latest you can start is 1 p.m :question:
I finished at 2a.m,was due back at 11 a.m but said I wasn’t comming into 2 p.m ( 12 hrs off ) as I was tired.
They say maximum variation is 2 hrs so 1 p.m,I just turned up at 2 p.m
Is there anything in black and white that says you can’t have off what you want if tired .

No idea where you’ve got that from. The only thing you cannot do is start before you’ve taken the minimum required daily or weekly rest. You can start whenever you want. I very rarely start any less than 13hrs after I finished the day before.

As for being tired it is entirely at the driver’s discretion. If you don’t feel fit enough to drive with a reduced daily rest then don’t take one. If you feel too tired to drive when down the road, park up. The traffic office can scream all they want but ultimately the decision rests with you.

How many days a week are you doing that? You can only do that three times a week.

Only when really struggling will i reduce from 11 hours rest, much prefer 12 or 13.

If i’m down for a 4am or 7am start, i always arrive on time, if i’m not going to make it due to finishing late the previous shift i’ll be in touch with planning long before i finish so they can plan me a later start.

If you agree the previous day you’re going to start at Xo’clock, it’s only right to be there on time.

That might be a company rule but it doesn’t form any part of the regulations.

Sorry Connor should of said reducing 3 days p.w,I’m now having 12 hrs off from when I finish now ,there not happy as they say they’ve no idea when I’m comming and loads etc are getting everywhere late as I should be there 11 a.m but are comming in 12 hrs from when I finished,but there still giving me loads that should of left 11 a.m even when I told them when I got back the night before I won’t be in until 00.30,1 am,2 am etc .

No there putting me down as 11 a.m starts all week,if I get back by 11 p.m then I’ll start at 11 a.m,but if it’s 2 am then I’m now going too have 12 hrs off as I’m getting more and more tired ,I tell them when I get back my start time the next day ,but was told I could only vary by 2 hrs max ,I just wondered where that rule of 2 hrs max came from

Thanks coffee that’s what I was after,it was apparently on a email,sent from boss to t.o saying drivers could only vary there start times by 2 hrs max .

If you finished at 2am then you are considered to be a night worker. The hours restriction on night working is for ANY 24 hours… :wink:

In fact I think ALL of the hours limits work on the basis that the limits should not be exceeded in ANY 24 hour period…

You think incorrectly as far as the EU driver’s hours regulations go. There are no limits based on a 24-hour period specified within those regulations, there are minimums in the 24-hour period defined though.

That sounds like a local rule, and probably brought in by the union rather than the managers (because it can make things more inflexible in the event of a problem)
As long as it’s a recognised agreement then stick to it, nobody should have a go at you over it.

This was a unwritten rule we used at co-op, when I was on planning.
It’s was to help the drivers. We wouldn’t deviate from their start time by more than 2 hours to help with their sleep patterns.
They last thing you need is tired drivers.

If a driver asked you for a specific start time one day, if you could do it, you would.
