15 hours too long?

Forcing a driver to break all sorts of rules is wrong. It’s nothing to do with the length of time

I agree forcing a driver to break the rules is ■■■■■■ up in this day and age but working a 15 hour day isn’t breaking the rules unless he’s already done three on the bounce.
I hate the way you get spoken too by some bosses the only scum is them !!!

I think 15 hours is too long in certain jobs, specifically multi-drop work where you’re basically flat out from start too finish…

As far as I can see he didn’t break any rules he just complained that he didn’t want to do the job, reading between the lines it sounds like he was sacked partly for doing a bit of ■■■■ stirring with the other employees on the day he worked 15 hours.

It might be interesting to see if the judgement is upheld at the appeal.

Why did the driver concerned take a selfie in a hall of mirrors then let the newspaper use it for his mugshot?

30K no wonder he looks chuffed, fair doos for getting one over on the buggers. Looks a bit like I did at that age, please don’t hold that against him.

Just love the companies response about their exemplary safety record. No company in the history of companies has ever said “well we are a little dodgy but have got away with it till now”.

The problem with something like this is that the day in question is but a mere snapshot of an employee and one set of circumstances, and may have no bearing on his usual and/or previous conduct, or what pound of flesh the company expects for their money or their attitude generally.

Seeing he’s been unable to find a job for 2 years since the sacking, despite moving to a different part of the country does, rightly or wrongly, give me misgivings about the claimant and his suitability for our industry.

So where has the drivers hours rules been broken, ? Most of us do 15hr days several times each week, where is his problem?

Whilst them sacking him if this was his first disciplinary , then they are wrong for doing that, but from what i can see he wasn’t asked to break any laws or driving regs ,

Driver shortage doesn’t apply to “whistleblowers” and will struggle to get employment in any industry.

Assuming that they don’t appeal and win it on the grounds that the hours weren’t actually ‘illegal’ he’s in a good position to start up as an owner driver.In which case if he’s got the sense to just go for full load distance work then the only thing he’ll need to moan about then is the stupid EU driving time limits.Which say that a driver can’t drive for more than 9/10 hours max but its ok to drive during a 15 hour day and/or start a new shift after possibly less than 6 hours sleep. :unamused: :wink: :laughing:

Which while we don’t have all the details, makes me think this case is more about bullying and intimation, rather than breaching any rules!
Hence the driver has faced discrimination as a result…

They will be advised against appealing IMHO. Due to the award being on safety grounds.

My lookalike could do with pulling his finger out though. 30k in my hands would barely last 6 months if I was 30 again.

The tribunal appears to have been about unfair dismissal. And yes, it’s unfair to sack someone just for whinging. Drivers whinge all the time - it’s in their nature.

I note though that he appears to have worked for the company for only about 8-9 months before being sacked - accepted wisdom hereabouts has always been that until you have been working for a firm for a couple of years you have few, if any, rights as far as employment law is concerned. I think this case has more to do with the employer ignoring the correct procedures and simply moving straight to dismissal.

Also, some of the other reports at the time (case was heard in October) suggest he clocked up 11 hours driving time that day.
