15 hour spread over

if you went over your 15 hour spread over by 4 hours but with plenty of driving hours to spare is that legal in certain circumstances?

for example:

you are driving to glasgow and are due to arrive approx 7pm.
the A74M is closed at 16.40 due to a fatality that i`m sure you will have heard about.
you are then stuck on the road for about 5 hours 20 mins.
when the road is re-opened at 22.00you carry on to your destination arriving at midnight!

is that ok or not?

I would say not… to be honest, I would have turned that 5’20" into 9’ and then continued.

and it was 2 hours as the other two were spent sitting in traffic and helping car drivers jump start thier cars. :laughing: :laughing:

who wants to do 15 let alone 19

hold you drove for 2 hours to get to Glasgow you would have past cafes and MSA naughty but its done

There is nothing you can write, sorry your friend can write, :wink: on the back of the record which will mitigate that, if your tachos, sorry your friend’s tachos, :wink: are checked within the next few months, not just the next 28 days or so, it could be your friend and his licence will have to spend some time apart. as well as your friend incurring a financial penalty.

if he was caught on the motorway in a traffic due to an rta then make sure that is on the tacho or print out also make sure the location what you should have done is ring the police and they would have given you an incident number to write on the tacho or print out

my view is that although you were caught up in something unavoidable,and it makes you go over that is fine-to your nearest safe parking /facilities area,as long as it is documented on the tacho/printout.no need to get crime/ref number.
however you cannot say,get stuck at lockerbie,go over time,then continue to glasgow,that is unacceptable.

In this situation you should only drive to the nearest ■■■■■■■■■■■■.

The maximum you should do after being told to move on is realistically about an hour, Unless you have real good reasons that can be verified.

All the above should be written on back of disc or printout, preferably with the coppers badge number that told you to move on…even better if he/she has signed the card.

Thats how I’ve always viewed my rights in this sort of situation

In this situation you had a Truckstop where this fatality happened buddy at Ecclefechan where that selfish numpty jumped off the bridge onto the road… Why didnt you divert up through lockerbie or were you stuck?? But yeah you could have stayed at the Fechan truckstop if not one of the 5 or 6 services up the M74 :smiley:

No never you must take your rest at the first available spot which in your case could have been any layby on the old 74 or johnstonebridge services. To get to glasgow you ran passed four service areas and countless other places you could have taken daily rest so basically if your cards are checked your up ■■■■ street
