13.5 hours driving

Been and wasted a day, but found out that after having 9 hours break you cannot start driving in the same day but you still need 11 hours of even though my example would mean having 14 hours. Also you have to do a printout at the end of each shift because digi cards only store 28 days information and when working for an agency they need to download your card. I know it’s not true but he thinks it is.

Where do they get this crap from?

I’ve heard that trainers can buy these courses off the shelf, that would explain why so many trainers come out with the same [zb].

Having a large amount of drivers we have drivers running out of driving time on a regular basis. Occasionally I will be sent to go and pick them up in a company vehicle. Not a truck, just a van or car and certainly nothing with a tacho in.

Some will flatly refuse to drive the van back and insist on 2 drivers being sent as they’ve ran out of driving time so don’t have any driving hours left to drive the van back. Worst thing is the company capitulate. And where do they get this from … ?

in the eyes of the law the drivers that refuse are right!
there was a famous test case many years ago… skills coaches! do a search!

How do you account for that when you do a manual entry when you next get in a truck ?

it will count if it’s work, ie a company car/van, I am no expert on manual entries on a digi taco

Our tacho card memory much more for 28 day.my card just start overwrite may 2013.
Printout-not legal requarement.can do,can not.some company not allow printout for nothing…
Drivers can drive have many he want-from 1 to some 10 shift between 2 weekly rest(144 hours)because shift can be 1 hours or up to 15.just need keep correct daily rest and maximum driving hours limit.
If drivers go from England to Russian he can do 6 in some 4-5 day.because he just drive.and if he start Monday he can use all driving hours ready Friday morning and must wait till Monday 00.00

In this case the driver has run out of driving time, so as long as he has enough working time left he can drive back to base in a van because that would be classed as other work.

The Skills Coaches case isn’t quite the same as the situation mentioned above.

In the Skills Coaches case the drivers were travelling to take charge of the coaches, which were not at the company depot, and not booking the travelling time.
The magistrates court referred the case to an EU court for clarification on whether or not the company were complying with the regulations.

The EU court decided that the company was at fault because even thought he drivers were making their own way to the coaches they should have been booking the travelling time as other work.

As long as the vehicle is a small van or car the driving is classed as other work not driving time.

As long as the drivers have enough work time left to reach base they can legally drive the vehicle back and do a manual entry for other work into the tachograph next time they insert their driver card.

yes I see now I should have put other work, getting close to the big 40 and for some reason I’ve started talking ■■■■!.. having done max driving hrs flat type work it was not that often that I had that much spread over left after loading, tipping and securing the load etc

They were entirely rhetorical questions. Just interested to see the response from Moose. I always ask the drivers that refuse and none of them can ever answer, for obvious reasons.
