12 week agency rule

Hi guys

Was hoping someone can help me. I am currently working for one client through an agency and have been for six weeks now but things are due to go a bit quite soon and they have told me they will prob only be able to give me 3-4 day a week. So what my question is can I take on other jobs though the agency to fill the the odd days without breaking the 12 week rule with the main client

Yes, as long as you are not away from the main company for more than 6 weeks you keep your rights.

You need to be available to your First agency and not running over Time. If you do and cant work for your Agency the second Week they may not phone you anymore.

Not quite right you could work for 5 agencies and do 1 day a week at 5 companies and after 12 weeks you have your rights. Only time you lose them is if you have a contract with your agency

Are you sure the 12 week rule applies? Many agencies are using the Swedish Derogation to get around it.

Only if the company the agency sends you to is the same companies for the 12 weeks. You have to have done 12 weeks with one agency client to be entitled to the same pay that that client pays their drivers under AWR rules. It cannot be just any agency client for the same agency for 12 weeks.

as long as you go in for a day a week and don’t have a gap of more than 6 weeks without working there your safe and fine.

you can work elsewhere so don’t worry about that either. I would check on which company as per conors comments as a load use Swedish derogation which means even if you do 12 weeks nothing will really change (there are a millions of things you need to do to cover under Swedish so check the contract).

you can work for other agencies - just make sure if your that keen to hit the 12 weeks you don’t upset who you are with now.
