10 hour rule

How do you sign out of the 10 hour rule,(working before 0400) is it within an agreement between drivers and manager?

If you mean opt out then all you need is to sign a written agreement between you and the company saying that you opt out .That’s what most of our drivers have done including me as advised by VOSA

It’s not more hours, just when the hours are worked.

Thought it was a collective agreement, we had to vote on this only about 12 months ago - majority or none.

Suppose if you’re self employed it’s quite easy to get a majority :smiley:

Legally you have to have a collective or workforce agreement put in place, individual drivers cannot opt out of the night time working rules, well not unless you’re the only driver there anyway.

Basically unless there’s a union representative, you need to get the drivers to elect a representative who will agree terms with the company/manager.

The opt out agreement has to be in writing and from memory lasts for 5 years, it also has to apply to a whole work-group group ie all drivers.

without the optout you CANNOT be asked to work more than 10 hours…with the optout you can be MADE to do 15.

My firm has a “Collective Majority Agreement” that is valid for five years.

That’s my understanding as well ,but since all of our drivers are self employed there is no need for a majority vote or any vote for that matter.

Some would be dumb assed enough to do any amount of hours they could, and for the same rate if it became legal,… you know the ones, those that approach and do the job like it’s some kind of endurance test until they eventually burn themselves out :unamused:

nope they can plan you a 15 hour day 3 times a week without breaking any laws.

Not forgetting that it is a 10 hour “actual working hours,” Not shift hours.

Indeed they can plan you a 15 hour day, its up to you and your size of bollox as to whether you tolerate and allow this to happen. You DO NOT have to work 15 hours regardless of it being planned or not and nobody can make you.
What give a spotty 8 hour clerk the right to ■■■■ up your life anyway, tell them to work 15 hours and only take 9 off and see what the response is.

If your planned on a 15 hr day whats the problem■■?
Under ur contract of employment its term as reasonable amount of overtime refuse and you could be back on the dole q.

If I understand it, I’m a free man and choose to work the hours that suit me once my contracted hours are fulfilled.

If my hours can’t be planned properly and the requirements of the business need a 24 hrs service then the correct number of drivers need to be employed.

If you’re contracted for a 45 hour week, you’re better off doing 3x15 because you’re not only getting 4 days a week off, but you’re only having 3x1 hour deducted for breaks.

Do 5x9 hours, and you’re getting 2 hours more deducted - ie 5 days of 1 hour deductions instead of 3. That’s two extra hours a week unpaid, on top of only getting 2 days a week off instead of 4…

When you consider that we’re all dead in 100 years, one would think that ‘time’ has more value than an “easy life” to all of us… :unamused:

I’ll think of you all when I’m sunning myself on the beach the rest of this week, having finished my week as of today’s shift end… :grimacing:
