Hi all, after some advice please.
I have a driver who’s licence expired whilst he was off long term sick. He is now back at work and has sent off his licence to renew and completed his medical.
Is he able to drive on a Section 88 whilst waiting for his licence to renew or is that just for people who apply for the renewal of their licence before old one expires?

There is no requirement to submit your application before the expiry of your old licence for Sect 88 to apply. All the other requirements still apply of course as set out in DVLA leaflet INF188/6.

Have you followed the complete process for using Section 88?
- Statement from Doc that driver is indeed fit to drive, for which decision they’ll need to referring to guidelines for medical practioners on assessing fitness to drive

- sending by recorded delivery, then
- checking for receipt at DVLA end (easily done online)
Be aware that simply having a completed D4 in the post does not mean he’s been assessed as “fit to drive”, doctors do not pass or fail people for a medical, they merely supply the data for the DVLA to make that decision.
