just been reading the lasest RHA Briefing
amongst other things it says:-
Self Employed drivers must have an operators licence.
Additionally drivers that are partners in a firm or who have limited liabillity will be treated no differently to sole traders, providing they do not regularly employ other drivers - and as long as the have an O’licence and meet the other parts of the definition, they will be deemed to be self employed.
for the employed driver it says:-
POA’s should be paid - because time spent on POA’s would usually fall under the provisions of the National Minimum Wage Regulations
