WTD/POA question

I did actually have a 2nd 15min break around the 12hour mark, but I was in a different truck, and for some reason the tacho changed to other work and I didn’t realise.

The first truck is a CRX? Unit and the second truck is the seimens one. I suspect it might be because I put the keys in the ignition to open my windows for fresh air half way through my break.

I know the first truck doesn’t change the tacho but I can’t think of anything else. I went to the shop, tailift wasn’t sat flush so upped it a cm. Got in the truck opened the windows and that’s about it. One of them changed the tacho from break to other work.

Some tachographs will default to break and others will default to other work when the ignition is switched on/off, it depends on how the tachograph has been set.

It’s always best to test it when driving a vehicle you’re not used to.

Other work anywhere between 4-10hours.

I’ve been told twice now by two different people since yesterday, I have to take 45mins before my 6hours.regardless of driving or otherwork.

Sorry for asking again, are they right?

No they are not. Unless they are in charge of your employment.

Get them to show you the legislation that states 45 min break required for 6 hrs work. Because it doesn’t exist.

But if it’s your boss…I guess just do as you’re told?

No they’re not right, well not unless there’s some kink of weird company rule in place anyway, and I’ve never heard of a company that insists on drivers having 45 minutes break before 6 hours working time, I suspect someone’s either winding you up for a laugh or they want you to drag the job out so they can to.

Legally you need to have a 15 minute break before exceeding 6 hours working time.

Swear they had me convinced. Something or another about combination of driving and other work. (but that is working time?!).

6 hours working time - 15min break unless you hit 4m30 driving time then 45min break due. (But I don’t ever hit that).

So 15 min before 6hr, another 15min before 12hours, but have to do 45min break total for the day (I do 9+ hours most days) under WTD.

So…might aswell do 15+30 which will reset my driving time and cover me under WTD for my 9+hour shift. (And ignore these people at work who say otherwise).

That seems like a good plan :wink:

As you say a combination of driving time and other work is working time, 3 hours other work and 3 hours driving is counted as 6 hours working time for the WTD.

AA want you to take your break between hrs 5-6 even if you have been waiting on a truck.

I didn’t even know alcoholics anonymous employed truck drivers :open_mouth: :open_mouth: :open_mouth:

Seriously though, some companies do have some strange rules in place, I used to drive for a large company who made us download our driver cards at the start and end of every shift, there’s nothing unusual in that but also at the end of each shift we had to take printouts then use the office copying machine to make copies of the printouts and hand them into the office with the printout and copy stapled together :confused:
