another way i look at it is…im expected to fulfill my duties without fault....so why doesnt this apply across the board.whoever is in charge of maintenance procedures has failed,so must accept the consequences…not just brush the problem under the carpet and pass the problem onto somebody else(driver)

wouldn’t you just fix it?

I would as said above as the trailer lights cover it. I’d make 100% sure they knew it was damaged before I got there though.
Somebody has smashed this light cluster, and the operator knows about it 
Then he has a duty to replace it or get someone else to take the trailer

how can they give you a PG9 for something that is perfectly legal?
and how can they give you a fine?
or is it a case of you just want to be a lazy ■■■■■■ and use it as an excuse to go home and toss it off?

Unless the vehicle is either going, or likely, to bobtail somewhere on the public highway there is no urgency to replace and it would just be done on the next six weekly inspection.
Where do you end up stopping with defecting road legal vehicles. VOR’d for catwalk lamp not working and calling out a 24hr fitter’s van out. If it was me in the van being called out I’d be deeply unimpressed TBH.
