Would i have a case?

Go to a job centre plus and ask for an et form, et stands for employment tribunal, I think its an et 1 form or something like that. Fill it out and send it back its all done independently and they will let you know wether you have a case or not. I done this 2 yrs ago when I resigned after a change of contract and settled out of court, it won’t cost anything to have a go .

Mine was just over 2 yrs ago and it was all free. The form you fill out goes to the employment tribunal board and its them who decide if you got a good or not. Cost me a first class stamp.

There are moves by some quarters to try to get some sort of Application/Claim fee introduced.

I doubt it will happen with any great consequence as it would be against the general principles of the current system.

You can apply online for a tribunal for this there is no cost. You enter the details of your claim it is then reviewed and depending on how strong your case is you may be asked to take part in a pre tribunal hearing. This takes place via a three way conference call with you, your employer and a independent judge. At this point if the judge doesn’t believe you have a case that can be won he can ask you to pay a non refundable deposit upto £500.

If you choose to carry on and lose you will also be liable for costs both to the tribunal and to your ex employer.

I know this because I went through it last summer. And IMHO I don’t think you have a case. I think you will find what you did would be classed as gross misconduct. You asked for the time off you were told no so you just didn’t turn up. I would have sacked you for that and if your honest with yourself you would have done the same if the boot was on the other foot.

if you explained the circumstances or a version to him and he still treated you like this he aint worth the hassle. either punch him or walk away with your dignity.

bit of an update, spoke to 1 of the lads i worked with an he said the firm have already employed another lad, which to me seems he had already had this chap lined up an was waitin to sack me ! for wha reason i dont no as av never had a run in with any 1 in this firm, got on with every1 wasnt a gossiper, an most of all i done my work !!

just goin to let this go by an not follow up a case or punch his lights out , although if when i go to pick my tools up he makes a snide comment i might change my mind !

You’re on a loser from the start.

Firstly, you’ve been employed for under a year so an employer can dismiss you for no reason.

Secondly, what you did could be classed as Gross Misconduct which is also instant dismissal.

In short, you ain’t got a leg to stand on and you handed them an excuse on a plate so I think your decision to let it go is the best.
