If you have parked on the public highway then walkaround checks with the engine running may be illegal

Regulation 107 of The Road Vehicles (Constriction and Use) Regulation 1986 (SI 1986/1078 )

“no person shall cause or permit to be on any road any motor vehicle which is not attended by a person duly licensed to drive it unless the engine is stopped and the parking brake is effectively set. Exemptions to the requirements of this Regulation as to the stopping of the engine include a fire brigade vehicle, the engine of which is being used for any fire brigade purpose.”

Would your company pay the fines if an over zealous copper needed an arrest?

So what about a vehicle running a PTO system, while the driver is outside operating whatever is connected to that system?

The legal requirement is for a duly licensed person to be in attendance, not in the cab.

theres been drivers done and fined in france for stopping at a peage,exiting the drivers door and going round the front of the cab to put your card into the machine,then climbing back into the cab after not switching the engine off…its ok to clamber across the cab and hang out of the window but not to leave when the engines running…and over zealous don’t really come into it when dealing with plod either here or abroad.if they wernt total bean counting jobsworths,then they wouldn’t be in the job in the 1st place.

If French law requires you to switch off your engine before alighting from the cab, then that’s what you must do (while in France). The law in this country makes no such requirement, so you don’t need to. The text of the relevant legislation has already been quoted.

I had to laugh the first night out in my artic, scania, I hit the check button on the fob in Lancaster services to do my checks at 5 in the morning, confident the reverse beeper wouldn’t go off, bloody wrong the bugger went off about 4 times :blush:
Ithought it was disabled on the dash but the old trailer has one on permanently on :imp:
