Vehicle checks showing up on a Digi Card

It does t say it anywhere it’s just seen as good practise. I for one go straight from rest to drive everyday but I know my lorry inside out and keep a good eye on it all the time so other than a quick check of fifth wheel I jump in the seat and I’m off.

Lets run that through a tacho check with VOSA.

“Mr. Switchlogic, we’ve noticed some lumps of tread missing out of your tyre.”

“It must have happened whilst I was driving down the road. It was OK when I did my check this morning.”

“But I don’t see that indicated on your tachograph anywhere. Mr. Switchlogic, can you describe your daily duties?”

“I go to the office and get my paperwork then give the truck a look over. I do the days runs, get back to the yard, fuel the wagon, do the paperwork, put the keys back in the office and go home.”

“But I don’t see that indicated on your tachograph anywhere.”

“But I do them”

“Every day?”

“Yes.”

“I notice there is 14hrs 58 minutes duty time on this day. There’s no other work period at the start and a minute at the end. Did you do your daily checks that day as required?”

“Yes.”

“So you exceeded your duty time and committed an offence then. Thankyou Mr. Switchlogic, we shall be in touch.”

Did you read any of my other posts before posting that? I’m assuming no because if you had you wouldn’t have posted something quite so wildly inaccurate…

But Conor that’s not how being a tramper with you’re own motor works now is it :wink:

By doing your walk round checks you are no longer on rest so legally your card has to be in the truck you are checking on ‘work’ and although you will get different vosa officers some cruel some kind you need to show at least 5 mins working before driving, even though on a vosa check you may not get done for it if heaven forbid an accident accrues and you as a driver ends up in court that 5 or 10 min work time on your digi card to show vehicles checks were done could just save your bacon. !!

No your card doesn’t have to be in when you’re doing these daily checks, you can put it in after and then show a manual entry for these checks that you did prior to putting in your card, I do this every day.

spot checks are done via cctv, I did get a verbal once for missing half of mine

And this is why I’ve never worked for a large and/or British company full time. I admire you chaps for putting up with it.

If your tyres haven’t got lumps out of them on a Thursday afternoon while you are tipping, it is highly unlikely that they will be damaged on Friday morning unless they have gone bald overnight :laughing:

The only time I went in our UK office was to pick up new CMR books or gloves. I was controlled from France and we did our communication by company phone or private email. The office had spare keys if my lorry was due an inspection and we were told by telephone at the beginning of the week. It was much the same on the tankers, we did our inspections as you were unloading and any defects would be sorted wherever we were, or they got us back to Holland if it sounded expensive

Can someone please tell me
a)if completing these manual entries is a legal requirement or just advisory ?

b) If this is a legal requirement then what penalties/fines can vosa give you?

C) we now have new siemens tachographs in our vehicles which now have a ? figure to show holidays, the chap who showed me insisted that we new some sort of letter to prove that we were in fact on holiday/sick etc, they are proving an absolute nightmare as unlike the old ones you now have to put the rest symbol in on your manual input, if you forget the last driving period continues and you could get an infringement for doing just pressing the wrong button.
d) can you just keep a diary of hours and days off?

I was under the impression thatt you have to keep a diary by law of all work/rest etc and the time it amounts too?
15 minutes other work is mandatory by most companys now to cover ones back…
That said it doesn’t necessarily mean those 15 minutes are spent thoroughly checking every nut and bolt holding the vehicle together. I’m the only person that drives my vehicle so I know when something isn’t right, so I put my card in of a morning make a brew, brush my teeth and have a walk round the truck before shooting off…always making sure the minutes add up to 15.

That’s a good way to do it, I show 15 minutes also but then some of that will be nattering and finishing off me coffee.
