Totting up happens when you reach 12 points in a three year period starting with the date of the most recent offence - it is the offence date and not the court date that matters. Penalty points stay on your licence counterpart for at least four years (longer for some serious offences), but only remain active for the purposes of totting up for three years.
The offences don’t all have to be in one go. In the original poster’s case, this is his fourth lot of three points for speeding offence in three years (and the fifth time he has been caught for speeding - he avoided points one time by taking a speed awareness course).

Yeh, you keep speeding fella and by paying fines make speed cameras even better at increasing revenue…don’t worry if you hit anyone matey, good luck to ya.
I hate speed cameras. But only because as a ‘safety aid’ they do not work, I hate them because they are another ‘tax’ on vehicle users. But to tot up 12 points in three years is frankly, bloody careless… you must have ■■■■■ observation skills mate…they are big ■■■■ off yellow things on poles…

a good few years back when i was younger and even more stupid lol and before i passed my hgv tests i ended up with 17 points on my licence without using the mitigating curcumstances thing (where you plead that it not only effects you but effects your family and ability to earn your families keep etc)
anyway at the time i was on 9 points
an sp30 which was 3
another time no insurance which was 6 (this was in my dads van which we both thought i was insured through the any other car 3rd party thing but didnt cover light commercials ie car derived vans and we both got done him for letting me use it uninsured and me for driving uninsured - so beware lol)
anyway i bought an old knackered fiesta to get to work and got stopped and issuid with a producer to which i had no insurance (yes i know i should have learnt but had to get to work and no work= no money to pay ins i was apprentice mechanic on a crappy yts )
so in a young and stupid way i ignored producer and ignored court letters and it went to court in my absence and i was charged with another 8 points
it was this point i woke up from my stupidness and relised or thought i had lost my licence due to totting up so i put an appeal in to go to court (i was going to go the mitigating curcumstances route as had a baby just due)
anyway gets in the court and the guy in the middle that relays thing to the magistrates asked me what am i appealing for so i said well ive now got 17 points so im banned but need my licence for job etc he came over and replied im not banned as the court the first time round didnt know how many points i had so just issued 8 points regardless i replied with well surely swansea will see how many i have now and is it not autamatic to which his answer was no only the court can ban you (rovoking it would be different i would have thought tho ie medical or tc)
anyway he turns around and says so you can carry on with your appeal you may win or you may lose but at the minute you have 17 points and no ban and still have the mitigating curcumstances to plead if you need it at a later date but he says you can only use that once in every 3 years and you might lose that now if you carry on so my advice to you would be to drop the appeal"
needless to say i was out of that court in a shot lol
and appart from getting flashed at hebron a1 nb a few month back at 47 i think which was gladly sorted by a speed awareness course(there not that bad lol) ive been clean ever since
also these points was still counting when i did my c and c+e so i was lucky to be granted provisional for them i would have thought too

I’m no expert on magistrate’s court procedures, but I would expect it to be straightforward for the court to check with DVLA in these days of computerisation. I would expect the sort of sentencing error suttle1 describes, where the magistrates imposed points without realising that disqualification due to totting up needed to be considered, is less likely now.
I still recommend that the original poster finds a solicitor who is experienced in road traffic law and has some experience of proceedings before his local Traffic Commissioner. Even if he avoids a ban in court, the Traffic Commissioner is likely to take an interest in his LGV entitlement.
