Blind driver that completely fails to read any of the large amount of “40” signs throughout that section = shouldn’t be on the road. There is simply no excuse and yes, I would prefer not to have to share the roads with thick [zb] like that thanks.

You will probably get a second letter, offering the speed awareness course. Take no notice of the wind up merchants, its easy to creep over the speed limit, when you are concentrating on road works etc.

I know it was my fault, after all, there was only 1 person in the cab that day, apart from the gremlins that is, but that won’t hold up in court will it!!!Just hurts my pride!!! :blush: :blush: :blush:

Just a thought for you…

Although the SAC is not supposed to affect your car insurance, like penalty points would…some insurance companies will ask at renewal if you’ve been on a SAC

I just renewed my childrens car insurances, and was asked if any of them has been on a SAC within the last 12 months… This was Admiral, but I can’t speak for any other companies…

I did a Speed ‘School’ course last year , (47 I’m a 40) & one of the first thing the Teacher told us, was- “we don’t tell insurance companies about your attendance, so you don’t need to admit it on any forms”
This is not Legal Advice, but I haven’t admitted it on any insurance since.

Darktower, just go for the course, you should be able to book one near to where you live. I got Zapped in Hull & did the course 1 mile from my home. (In Milton Keynes)

When you do it, there will probably be only one or two HGV drivers on it with you & I was amazed at the General HGV Ignorance of the rest of the class, one seemed to think that because we’re Big-we’re fast ! a lot of the others didn’t realise how much room we need to manoeuvre & most of them didn’t know why we do 40 on single carriageways ? (I had to remind them that it’s the law & it’s in the Highway Code, Durrrr !)
It’s an eye opener & I reckon that they should be compulsory for all learners.

First you get a letter stating your offence etc,you reply to it with a letter pleading guilty in a grovelling way,then wait for the reply,but in the mean time pack a bag and explain to the kids Daddy might not be coming home for a while :smiley: :laughing:

Oh dear, another Armchair Lawyer… Incorrect posts like this should not be allowed, it could end up costing the OP the chance of a Fixed Penalty or Speed Awareness Course.

At this stage you / your company will receive a NIP - This is merely to ascertain the driver of the vehicle, you will get your own once the company names you. To this, you will need to sign the form to confirm you were driving and give your Driving Licence Number.

They will then write back and either offer you a Speed Awareness Course or a Fixed Penalty. At this stage, you are able to settle without going to court.

If you get bolshie and start asking for proof/evidence etc. then they are more than certainly going to withdraw the SAC option, possibly both and refer it to the magistrates court, after all, speeding is a criminal offence.

There is no way you can appeal a FPN/NIP, you either accept it or you don’t. You are not entitled to any evidence until you plead not guilty at court.

Maybe i should have been a little clearer. I didn’t mean ignore it but more if you think your genuinely innocent or there could have been a mistake then fight it. You have a right to appeal.

You have no right to appeal a fixed penalty. you would have to reject it then plead not guilty in the magistrates court.

It ■■■■■ but it is also the law. by telling someone to fight it would then have to argue his case in front of 3 magistrates. If you are found to be 1 mph over the limit then you are guilty and the prosecution costs, fine and surcharge would be astronomical. probably over 600 pounds.

Not a cheap fight.

These are true and not guesses:

There is a table in there. In a 40mph device activates at 42mph. At 46mph you get done Fixed penalty if education is not appropriate which means you have already had a SAC in the last three years. If you have never had one you will be offered one if your speed is in the range of 46 - 53mph so this is what will happen to you. It cost me £96 they vary slightly and you will be offered a few places and dates to book in. When you turn up the police are notified that you have attended the full course (Half a Day) and that is the end of the matter. You are told on the course that you have not been prosecuted for a driving offence but instead have been offered the education so you do not need to tell your insurance company

If its any consolation to the OP, I got 3 points for speeding in 2005 (36 in a 30) after having a clean license for 22 years! Happens to the best of us mate.

  • Do not fight it, you WILL get £1000 fine and 6 points I know two people who did this on bad advice

That is very true!
The system is tailored to ream you no matter how good the evidence you think you have to fight it!
I heard of one such case where there was witness evidence and a whole raft of other stuff against the copper with a hand held speed measuring device and the guy on the receiving end still lost the case!

It’s all a load of ■■■■■■■■.
