Lack of sleep, attitude were the factors, phone had sod all to do with it.

I would guess that, even though it’s pretty stupid, having only 4 hours sleep in 31 hrs is not against the law while using the mobile, as proven, is.
I cannot remember but did the law change regarding his loss of licence? He’s banned for 5 years but I remember someone trying to get the law changed so that his ban won’t start until he gets out, which seems fair to me as being banned while inside is pretty pointless.

That’s correct, but he wasn’t charged with being on the phone he was charged with dangerous driving. The phone aspect is brought up by the papers that use this type of incident to try & make more of it than it was. Man falls asleep while driving and causes accident is pretty boring for them. Trucker kills motorist after watching ■■■■ & making 40 minute phone call while driving is much better headline for the media. The fact that that was irrelevant to the incident doesn’t matter to them.

And the only good thing going for him is the fact he didn’t kill himself!!!
So, your weekly rest has to be that. A rest. But you are also free to dispose of your time as you wish. Your garden needs some decking/stone slabs laying. Can you do that during your time off? Or should you do nothing physical at all??

where do you draw the line whilst driving.mobiles,watching tv,cooking your dinner,making sandwiches,talking to a passenger,strangling a hitchiker,…music up loud and singing,or arguing with that condesending snotty mealymouthed english voiced ■■■■■ on the satnav after youve just had a shouting match with the similar voiced slimey cow topping up your o2…( il turn when im good and ready to turn,and not when you tell me ya cow)!!! .they all distract you to a certain degree.
personally its normal practice when your driving and clean wrecked,its easy enough to just call someone and have a gab for a while till the sleep wears off…obviously it looks like he was doing the same on the way up the road,as well as watching chug material to keep his eyes opened…
apart from the usual holymoly brigade on here,then most people speed as its just the normal done thing,and most use phones when driving.if it was seen as a crime,then most wouldnt be doing it…its all a question of personal opinion as to what degree is acceptable…mine will be similar to others,and completely opposite to the squeaky clean brigade…he messedup bigtime,and for the ones that say its not long enough,then im sure his couple of years inside with the accompanying pondlife will seem like 22 years to him (assuming hes not been in before).the guy that whacked the back of the minibus on the m62 got away with it,this dude didnt…
