“Go back and get me 2 printouts please, this is what you have done wrong…” that would have avoided the whole problem. It’s the TM’s job to worry about compliance granted, and as the OP is agency perhaps he couldn’t be bothered. But ■■■■ me that was not the actions of even a halfway competent TM.
It was a siemens (vdo) and I have just watched the video on youtube. I must have told it I had been working all night when I did the manual entries as I have not used a siemens for a while so it caught me out. Oh well if you can’t do the time then don’t do the crime so I will just have to hope for parole?

I am not going to name the company but if I did you would “understand” They have had VOSA on their backs for a while and keep getting checked, drivers leave all the time and they have to use a lot of agency drivers

Exactly, why even bother to take that knob head seriously , it will just encourage him, another office bound robot that lives in a theory world. You have done nothing seriously wrong mate, just made a mistake on your man ent, …move on they can not hang you.

Dont worry ive had the same…last day at work before 4 rest days.returnef to work,put card in tacho and this is the msg i got…the tacho unit fault was it never showed me having finished work 4 days ago.

Thats what you have to deal with as an agency man. Also, if you are looking to keep tabs on your hours then use this site.

From my reading of the OP’s account, no-one (apart from the tacho and the bloody computer!) thinks that driving hours have been exceeded. The TM’s concern appears to be (quite correctly from his POV) that an infringement will appear on their records. TBH neither party involved here comes out in a particularly good light - the OP for simply continuing with his day and making no effort to investigate the problem or produce a handwritten record even when the tacho had alerted him to Something Not Right and the TM for blustering rather than dealing with the issue at hand. We are supposed to be professional drivers and know the correct way to deal with e.g. mode switch mistakes, that we should carry supplies of printer rolls etc. This is basic CPC Drivers Hours stuff.
And for the avoidance of doubt, I’m not saying the OP is a Bad Person - every day is a learning day in my book. Chalk it up to experience, move on and (hopefully) don’t do it again
Maybe they do some other work before putting their card in (or after taking it out). Maybe they have to stand around for an hour or more waiting for their designated unit to get back from its earlier run. Maybe they are simply capable of doing more than driving…

It could be because the previous driver left the mode on rest or other work, and the driver did not notice, therefore his manual entries could be wrong ?

Don’t think so - in my experience the tacho picks up the mode setting from the current driver’s card, not from whatever the previous driver was doing.
I have put my hands up and admitted that I cocked up the manual settings. I had to do a manual entry as I had been in the yard 40 minutes before getting this unit. I also had to change the previous day finish time. This process is easy to do but the problem stems from not enough info on the screen and three types of tacho in use that run the menu differently. Anyway I will do my best not to let it happen again There is no need for Trucknet CSI to be on the case here as the culprit has admitted his short comings
When you put your tacho in and recorded shift ending at 17.45 you should have logged from that time to start time as rest. If you don’t the card doesn’t know and assumes you were on duty.

Unfortunately this is often the cause of the problem in the first place. In the newer version of the Siemens VDO, which I think started appearing in 62 plates or around that time, if you skip the manual entry it adds the time from card ejection to card insertion onto the card and will assume you never clocked off. This is how people insert their card and it tells them they’ve already drove for 4 hours. Whatever driving time you were on the shift before it will say the same after you reinsert the card.
In other words these things are not fit for purpose. Difficult to get right and not consistent across makes so we are bound to be tripped up by them. Siemens is another word for ■■■■■ in my book
