This might surprise you, but some of us are happier in a layby or industrial estate than a truck stop or MSA.

Just to add something , if you do that and run over your time make sure you take a printout for the run over just over 1 minute after you have stopped and wright on back of the two copy’s one for you and one for the company. and then in the morning when you put you mode to work take another two printout to explain the insufficient rest you had, as 16.5 and 9 don’t go into 24 hours.
You should remain on “rest” for at least 9 (or 11, if you have already had your permitted reduced daily rests for that week) hours. Yes, this means that your start time for the following day(s) will be later than planned, but the emergency/unforseen event is long gone by then. If your load(s) need to be rescheduled or trans-shipped then so be it.
yes but when he starts work next morning he will have an infringement for insufficient rest as 16.5 hour duty and then and you could not get a 9 hour rest in 24 hours you would only have had 7.5 hours rest and that would be an infringement and recorded as one.
he could have started a 24 or 45 hours rest but he would still have an infringement for insufficient rest for the Saturday

This might surprise you but I also park in ind ests, places I have found over the years on edges of town. truckstop if I have to, MSAs never, lay bys never.

It doesn’t matter how many printouts he writes on, he’s still going to get an infringement. He will still have to carry the Saturday printout with him for the next 28 days, so his record of the circumstances will remain available to VOSA or Police.
I would also take issue with the advice to take two printouts and write on them both (one for driver, one for company). He only needs to take one printout and write on it - He keeps this with him for 28 days and then hands it in to the company. If the company want a copy for their files in the meantime, they can take a photocopy.

there is two issues here him running out of time which requires a print to two explain why, and then the insufficient rest he had when he start Sunday morning a print out would be require as there two separate events.
and my company download ever week and require original copy’s for the print out so there can be put with the file. we did do photo copy’s but are compliance officer said no must be on same paper as tacho roll. the other copy if for you if stopped and after 28 day throw it in the bin.
I can confirm this as I have run over and done this and been stopped few days later and Vosa questioned this and I had two printouts on for the over run and one for the insufficient rest was very satisfied with that and let me on the way.

i didnt read down over all the above comments. but 4 months ago i got held up behind a over turned lorry. i had a full load of chicken meat on.i was delayed by hours. i phoned the company that i was pulling for and told them i wouldnt make it to the coldstore within my 15hr spread. because of dates on the chicken meat this meant that the load was going to bevalue and there would be a fine from tesco or maybe the load sent back.the price of the fine from tesco was going to b far higher than what mr vosa would gave me. anyway i went on, tipped and took about 13 hrs off. i did a print out and wrote “i got caught behind a RTA on the A55 (place,date,time) i had to go over my daily spread by (cant remember the time)because due to load going to lose value due to short dates”…well after time off i headed for they dartford tunnel and low and behole didnt the vosa pull me. i explained why i did what i did. he told me that he understood and because i didnt make a hadit of it i was free to go without any fines. he did warn me that if i hadnt of done a print out explaining my reason he would of fined me…
