I have seen drvers fined in other countries for putting on break while being loaded and yes they were sat there doing nothing and we have the same drivers regs here as they do in europe so I’m speaking from my own experience. As i said if it helps out then yea i put it on break when tippiing but I will also take 30 mins or so somewhere i can get some decent food and break. But also it works both ways and rest on the bay shouldn’t be factored in when planing the runs

according to GV262 a break is
Break or rest Covers breaks in work and daily or weekly rest periods. Drivers
may not carry out any driving or any other work. Break periods are to be used exclusively for recuperation. During a rest period a driver must be able to dispose freely of his time.
which is fine if they are genuinely not helping load or unload !

Yes it’s other work, but mostly ignored. just the same as the boss phoning you whilst on a break, or a vosa man talking to you when on a break, but that could be entrapment.
and don’t ever tell vosa that you’re playing devils advocate, that’s a whole lot of other regulations. i believe you could end up in the hague for that one.

I wouldn’t , you can break while you’re waiting , walking to get it would be other work !
I doubt anyone has been fined on the mainland for that if they were not working, but if they were observed strapping the load or closing curtains then they were at work, and if you produce GV262/3 in France you may as well show them a coconut 
Most companies have a proper facility with canteen clean showers and a rest room for the drivers, and they don’t do that silly thing of locking you out of your own cab
