Penalty for no mot and tax disc

No insurance policy i’ve ever had has stated it would be invalidated if the vehicle has no tax, that simply isn’t true. The only means that would invalidate the insurance is not having a licence or something else that was undeclared

There are far too many myths & MMTM stories about insurance, that being one of them :wink:

Ok, here’s what happened to me, a few years ago now but still relevant.

Driving my gaffers motor one day and some prick comes flying round the corner totally on the wrong side of the road, causing me to swerve and collide with a parked car. I couldn’t find who the car belonged to so I left a note then made a report at the local nick when I got the chance to cover myself. PC NEIL FRODSHAM, a woodentop from Wigan way,although this was South London, took a statement from me. This included the material fact that it was my employers vehicle. Now the fun starts!

I was given a producer but when I got back to the office that years certificate couldn’t be found. At the time my boss was of the female variety and had very recently lost the twins she’d been expecting at about the 7 month mark so she wasn’t in any shape for me getting narky with her. Off I went with the docs I had and explained to the copper recording the details that my employer was unable to furnish me with an insurance certificate. I expected to hear more about it and I wasn’t disappointed!

The expected summons duly arrived but rather than pleading guilty by letter I decided to go in person as I had something to say for myself. At court the charge was read out and the clerk asked how I intended to plead. I plead guilty mainly because I did think I’d committed an offence. Now the interesting bit! I was asked if I’d anything to say and I certainly had. When the clerk heard the bit about it being my EMPLOYERS vehicle he advised me to change my plea because as an employee I had NO right in law to see a certificate of insurance therefore had to work on the assumption that my employer was complying with the law!

I returned to court a few weeks later and had the pleasure of seeing the woodentop FRODSHAM turn a lovely shade of red when the clerk of the court asked him why he’d taken that course of action when he was in full possession of the facts regarding ownership of the vehicle.

BTW some larger companies DON’T have insurance. They are covered by their own bond. I presume the plods can verify that when you get a stop somehow?
