Part 36 will often be used to put the claimant under pressure to accept as the article in the link posted by wildfire says costs can be reduced or declined should the award of the court not better the pre hearing offer. The other thing to consider is that the part 36 may also have a gagging component to prevent the offer being made public. Your own legal representative may advise acceptance as this way they still gets paid and the insurance that has been taken out will not be needed so his/her premium isn’t increased by “losing” to many cases.
Only this week Charlotte Church and her family have had a very large settlement in the phone hacking case, and I have no doubt, having turned down a part 36 offer that was much lower than the award made in court. Thier settlement is a lot higher than those others who have settled out of court (John Prescott, Jude Law, Sienna Miller).
